Resolution No. 17-193
A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS CERTIFYING THAT IT HAS REVIEWED
AND CONSIDERED A NEGATIVE DECLARATION PREPARED BY THE CALIFORNIA WATER SERVICE COMPANY FOR THE
CONTINUANCE OF THE CONVEYANCE OF THE REDIRECTED CONTRACT PG&E WATER FROM THE MIOCENE CANAL TO
THE THERMALITO POWERS CANAL AND AUTHORIZING CLERIC OF THE BOARD,TO FILE A NOTICE OF DETERMINATION
WHEREAS, the Board of Supervisors entered into a water conveyance agreement with California Water Service
Company and the Department of Water Resources of the State of California for the Delivery of PG&E Water in accordance
with the terms of the County of Butte's State Water Project (SWP)Water Supply Contract in July 2014; and
WHEREAS, this agreement sunsets on December 31, 2017 and the Board of Supervisors wishes to renew such
agreement; and
WHEREAS, in 2014, the County of Butte passed Resolution No. 14-079 certifyong that of had reviewed and
considered a Negative Declaration prepared) by the California Water Service Company for the Redirected) Contract PG&E.
Water from the Miocene Canal to the Thermalito Powers Canal through December 31, 2017, and authorized the Clerk of
the Board to file a Notice of Determination; and
WHEREAS,the County of Butte, acting as lead agency, has determined it was appropriate to prepare an additional
Negative Declaration for the continuance of conveying Redirected Contract PG&E Water from the Miocene Canal to the
Thermalito Powers Canal; and
WHEREAS, the Board of Supervisors, as the lead agency, consulted with California Water Service during the
environmental review process; and
WHEREAS, the Board of Supervisors has reviewed and considered the Negative Declaration for the Continuation
of Redirected Contract PG&E Water from the Miocene Canal to the Thermalito Powers Canal in accordance with the
California Environmental Quality Act; and
WHEREAS,the Negative Declaration does not identify any significant impacts within the jurisdiction of the Board
of Supervisors as supported by the following:
• No new construction or improvements by Butte County, California Water Service Company or the California
Department of Water Resources would occur with the proposed project;
• California Water Service Company will continue to meet its contractual obligations to its existing rural
irrigation customers along the Lower Miocene Canal;
• California Water Service Company will continue to provide sufficient carrier water to accommodate seepage,
water loss due to leakage and evaporation to meet these contractual obligations;
• The delivery of the PG&E water from the Miocene Canal to the Thermalito Powers Canal would occur within
the operating conditions of the State Water Project as determined by current licenses, permits, regulatory
constraints, interim remedial actions and all applicable Biological Opinions and would therefore have no
impacts upon the environment that wound require mitigation; and
WHEREAS,aduly noticed public hearing on the Redirected Contract PG&E Water from the,Miocene Canal through
State Water Project facilities (Lake Oroville to the Thermalito Powers Canal) was held before the Board of Supervisors on
November 14, 2O17; and
WHEREAS, the Board of Supervisors has considered the staff report and recommendation of the Butte County
Department of Water and Resource Conservation and the Butte County Department of Development Services, Planning
Division, and public comments.
NOW,THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors takes the following actions:
1. Certifies that it has reviewed and considered the Negative Declaration for the Redirected Contract PG&E
Waiter from the Miocene Canal tothe ThernmaU|toPowers Canal.
2. Finds the Negative Declaration tobeadequate for the purpose nfentering into conveyance agreements with
the California Water Service Company and the California Department of Water Resources.
3. Finds that there are no significant impacts within the jurisdiction of the Board of Supervisors identified in the
Negative Declaration.
4. Finds that there is no need for the Board of Supervisors to mitigate any potential impacts.
5. Authorizes the Clerk ofthe Board toprepare and file aNotice mfDetermination.
