Resolution No. 17-1.95
RESOLUTION CONTINUING THE PROCLAMATION OF A LOCAL HEALTH EMERGENCY
DUE TO THE CHEROKEE AND LAPORTE FIRES
WHEREAS, on October 8, 2017, wild fires callled Cherokee and LaPorte began in and around the County of
Butte; and
WHEREAS, the Cherokee and LaPorte Fires have burned more than 14 thousand acres of land, destroying
multiple structures in Butte County, including homes, and caused the evacuation of residents and damage to roads
and other critical infrastructure; and
WHEREAS, on October 9, 2017, Butte County Chief Administrative Officer Paull Nuhn declared a local
emergency in Butte County, which declaration was ratified by the Board of Supervisors on October 10, 2017; and
WHEREAS, on October 9, 2017, Governor Edmund G. Brown Jr. issued an emergency proclamation for Butte
County due to the effects of the fires; and
WHEREAS, together the LaPorte and Cherokee Fires destroyed an estimated 42 homes, 4 commercial
buildings and 50 additional structures, and as a result created an enormous amount of debris; and
WHEREAS, the debris resulting from the LaPorte and Cherokee Fires contains hazardous material in the ash
of the burned structures,which has created a health emergency and poses a substantial present and potential hazard
to human health and safety and to the environment unless it is addressed and managed; and
WHEREAS,the approaching rainy season threatens to spread the hazardous material in the ash of the burned
structures and could thereby pollute and contaminate the drinking water supply of the affected areas of Butte
County, and
WHEREAS, under the provisions of section 101080,of the California Health and Safety Code, Local the Health
Officer may declare a local health emergency in the jurisdiction or in any area thereof affected by hazardous material
that is an imminent threat to the public's health; and
WHEREAS, on October 18t', 2017, the local Health Officer found that a local health emergency existed in
Butte County due to the debris resulting from the Cherokee and LaPorte Fires, that contains hazardous material in
the ash of the burned structures, and posed a substantial present and potential hazard to human health and safety
and to the environment, unless it is addressed and managed.
NOW, THEREFORE, BE IT RESOLVED that the Declaration of Health Emergency in Butte County due to the
debris resulting from the Cherokee and Laporte Fires that contain hazardous material in the ash of the burned
structures as described above shall be deemed to continue to exist until its termination.

following vote:
AYES: Supervisors Wahl, Kirk, Lambert, Teeter, and Chair Connelly
