Resolution No. 17-212
RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS
RESCINDING MINUTE ORDER 79-646 ADOPTED ON FEBRUARY 27, 1979
RECOGNIZING CRAIG ACCESS ROAD AS A NON-COUNTY MAINTAINED ACCESS
WHEREAS,the California State Department of Water Resources(DWR) purchased Craig Access Road in fee in the
1960s; and
WHEREAS, DWR 'indicated that Craig Access Road was purchased to provide access for maintenance activities at
the Craig Recreation Area and that the road is adequate for this purpose; and
WHEREAS, DWR has stated that it shall not be responsible for maintenance on Craig Access Road; and
WHEREAS, DWR has, in the past,given property owners written permission, generally by means of a permit that
is subject to revocation by DWR,to use Craig Access Road to access their properties; and
WHEREAS, DWR has indicated that it may no longer give property owners a permit to use Craig Access Road;
and
WHEREAS, property owners have relied on the DWR permit to demonstrate that they have the legal right to
access their properties by driving along Craig Access Road; and
WHEREAS, the Butte County Board of Supervisors, on February 27, 1979, approved by Minute Order 79-346 that
Craig Access Road be recognized as a no'n-county maintained access provided written permission is obtained from the
State allowing property owners the ability to use Craig Access Road as a right-of-way.
NOW,THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors:
1. Rescinds Minute Order 79-346, dated February 27, 1979, and will no longer recognize Craig Access road as a.
non-county maintained access; and
2. Will evaluate the status of Craig Access Road once the health, safety, and welfare concerns have been
eliminated.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 1.21h day of December,2017, by the following
vote:
AYES:Supervisors Wahl, Lambert,Teeter, and Vice-Chair Kirk
NOES: None
ABSENT:Supervisor Connelly
NOT VOTING: None �
