The B.aard of Supervisors of the County of Butte
DD ORDAIN as follows.;
Section 1, That Article VI of Chapter 2 (Sections
2-2'~ - 2--28) of the Butte County Code is hereby repealed and is
re--enacted to read- as follows
Article VI - PERSONNEL AND MERIT SYSTEM
Section 2-27. Pu~pase,
The purpose of this Article is to provide far the
,establishment of a Merit System and Personnel Program to
regulate the appointment, advancement and removal of persons
to the employ of the county. The Merit System and Personnel
Program shall provide. for the analysis and classification of
jobs, establishment of adequate and equitable wages, fringe
benefits and retirement plans? development of effective recruit-
ment, selection, placement, training, employee evaluation and
promotion programs; assurance of equal employment opportunity
of persons consistent with merit principles without regard to
race, national origin, politics, religion, age, sex or
other non-merit factors; protection of employees from discrimina-
Lion, arbitrary removal, and political pressures; development
and administration of positive employee--management relations
land communications to promote improvement of personnel
management and employer relations by providing a uniform basis
;for recognizing the rights of county employees to join
organizations off` their own choice and to be represented by
such organizations in their employment relationship with the

county~or to refrain from joining such organizations.
Section 2-28. Rules for Administration to be
Adopted. by Resolution.
The Board of Supervisors shall by resolution
adopt rules providing for the administration of the Merit
System and Personnel. Program.
Section 2-2g.
Personnel Director.
A Personnel Director shall. be appointed by the
Board of Supervisors. The Director shall be responsible for
ithe administration of Merit System and Personnel Plan and
shall have authority to appoint such employees for personnel
work as may be allowed by the Board. The Personnel Director
shall: establish methods and procedures necessary for the
proper functioning of the Merit System and Personnel. Programs;
provide such personnel services and assistance to department
heads and employees that will contribute to the efficient
conduct of the county's business; maintain such records necessary
for the effective administration of the Merit System and
Personnel Program, including a file for each employee which
will be available for review by the employee and authorized
persons; provide the Board of Supervisors with such reports and
information as they may require; serve as clerk to the
Personnel Appeals Commission. Actions of the Personnel. Director
may be appealed to the Board of Supervisors.
Section 2-3a. Classif~.tion Plan.

1 officers, boards or commissions, shall be included in a classifi~
2 cation plan and sha11 be classified according to the duties and
3 responsibilities in such a way that equitable schedules of
4 compensation may be applied. Each class shall have a title,
S and a written specification defining the class, describing
6 examples of duties and typical tasks related to the class and
7 setting forth the employment standards and qualifications
$ required of persons appointed to positions in the class.
9 Section 2-31. Salary Plan.
10 All classes of positions in the classification
~1 plan shall be assigned a salary range or rate as provided for
12 by a salary ordinance. Employees appointed to positions in the
13 classification plan shall be paid a salary within the range or
14 rate so provided for in the salary ordinance and according to
15 the procedures established pursuant to Section 2-28.
16 Section 2-32. Appointments and Employee Status.
17 All non-elected department heads shall be
lg appointed by the Board of Supervisors or as provided by law.
lg Appointed department heads sha11 serve at the pleasure of the

21 Appointments to positions in the classified
22 service shall be made by department heads or their designated
23 representative. Regular appointments to positions in the
24 classified service shall only be made from among those persons
2S certified by the Personnel Director as being qualified applicants

shall be made in writing on forms prescribed by the Personnel
Director. The .Personnel Director shall before approving any
.appointment to the classified service determine that there
is a vacancy in an authorized position as allocated in the
,salary ordinance that the work to be performed relates to the
concepts of the posa.tzon as described in the class specification
and that the appointment was made from among the highest ranking
available qualified candidates far the position.
A copy of the approved appointment sha11 be
,delivered to the County Auditor before payment shall be made
Ito any employee occupying a position in the classified service.
Each employee appointed to a position in the classified service
has shown in the salary ordinance who successfully completed a
probationary period not to exceed one year sha11 have permanent
(status.
Section 2-33. Merit Advancement.
An employee in a classified service sha11
receive a merit pay advancement only upon satisfactory performance
hand in accordance with the procedures established pursuant to
Section 2-28.
Section 2-3~. Discharge and Disciplinary Action.
An employee may be discharged, demoted, or
suspended only for reasonable cause. When a department head
believes reasonable cause exists, the employee sha11 be given
a written notice specifying the disciplinary action taken, the
~~effective date and the reason for the action. An employee with

permanent status shall have the right to appeal. that action
pursuant to the rules established under Section 2-2$.
Section 2-35. Personnel Appeals Commission.
The Board of Supervisors shall appoint an
impartial Personnel Appeals Commission consisting of five
persons knowledgeable in the field of employee relations.
Two Commission members shall be appointed for a term of office
to expire December 31, 1977, two Commission members shall be
appointed for a term to expire December 31, 1979, and one
.Commission member shall be appointed far a term to expire on
;December 31, 1Q80. Upon the expiration of the aforesaid terms,
appointments to the Commission shall be for a term of office
of four years. Vacancies in the office of Personnel Appeals
Commission shall be as provided in Government Code Section 1770,
or any successor section thereto, and in addition thereto a
vacancy shall occur in the event a member misses three
consecutive meetings of the Commission without being excused
by the Commission. The Commission shall have the power and duty
to conduct hearings, to subpoena witnesses pursuant to the
authority established by the Board of Supervisors in Government
Code Section 25170, et seq., and to make findings and orders
for appropriate actions all pursuant to the procedures and
;regulations established by the Board of Supervisors pursuant
~to Section 2-28. The Commission's findings and orders shall
fbe a matter of public record and shall be binding on all parties.
Any court action brought by either the county or the affected

employee must be brought within thirty (30) days of the entry
of the final order of the Commission in a matter. In instances
where the Commission orders reinstatement of an employeets
back pay and benefits, the County Auditor shall upon written
notification by the Personnel Director implement procedures
to comply.
Section 2-36. Any member of the Personnel
Appeals Commission may be removed far cause by the Board of
Supervisors.
Section 2-37. The Personnel Appeals Commission
may as provided in the rules established by the Board of
Supervisors pursuant to Section 2-28 appoint a hearing officer
to conduct hearings and make findings of fact.
Section 2. This ordinance sha11 take effect
thirty (30) days after the date of its adoption, and before
the expiration of fifteen (15) days after its passage, it shall
be published with the names of the members voting for and
against the same in the
a newspaper published in the County of Butte, State of
California.
