HomeMy WebLinkAbout1740ORDINANCE N0. 1740 1 2 3 4 I 5 e 7 8 9 la 11 12 13 14 15 16 17 18 19 20 21 22 23 24 2~ 26 AN INTERIM ORDINANCE 2ONTNG A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A "R-1" (SINGLE-FAMILY RESIDENTIAL} DISTRICT The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No, X75, as amended and declaring an emergency, DO ORDAIN as follows: SECTION 1. The hereinafter described area situated in the County of Butte, State of California, shall be and it is hereby zoned as a "R-]," (Single-Family Residential} District for a period of 120 days, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in Thermalito, more particularly described as follows: A portion of "Thermalito Sub" per map of record ~Uall Map No . 6 on file in the Office of the Butte County Recorder described as: That property located south of. Grand Ave., west of 12th St ., east of 14th St ., and north of the centerline of Sierra Ave, (now abandoned} , Containing 26 acres, more or less, Orovill~; SECTION 2. REGULATIONS FORA "R-1" DISTRICT: The following regulations shall apply in a "R-l" Distric 2.1 USES PERMITTED: a. Single-Family dwellings, not including tents or trailers. b, Accessory buildings pertinent to the permitted uses c. Household pets (but not including livestock, poultry, or poisonous reptiles}. t: -1- 1 2,2 LOT AREA REQUIRED: 2 Minimum xequired area of a lot per dwelling unit 3 shall be na less than eight thousand, one hundred 4 twenty-five [8,1.25) sq, ft. 5 2.3 LOT WIDTH REQUIRED: 6 Minimum lot width shall not be less than Sixty -five 7 (65) ft . 8 2 , 4 FRONT YARD REQUIRED 9 Minimum front yard shall be fifty (50) ft, from the 10 centerline of the road, except where the road is 11 classified by the County as a Federal Aid Secondary 12 Road, the minimum building setback requirement shall ],3 be fifty-five (5S) ft, from the centerline of said I4 road. 15 2 .5 SIDE YARD REQUIREMENT 16 Minimum side yard shall not be less than five (S) 17 feet. 18 2.b THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT i 19 IN EACH CASE: ~ i 20 a. Golf courses and country clubs . 21 b. Public and quasi~pubiic uses including churches, 22 firehouses, hospitals, parks and playgrounds, school: 23 and public util ity buildings . 24 SECTION 3. In compliance with the provisions of said Zoning Enabling Drdinance, the same is hereby amended by adding this Ordinance in full. SECTION 5. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance , SECTION b. This urgency ordinance shall take effect immediately upon its passage, and before the expiration of fiftee (15) days after its passage shall be published once with the name of the members of the Board of Supervisors voting fox and against the same in the Oroville Me:rcu~y , a newspaper in general circulation in the County of Butte, State of California. The facts constituting the urgency on which this Ordinance is based are: 1.
