HomeMy WebLinkAbout1749~~ y Or~_inance No. 179 1 2 3 4 6 7 8 9 la ~.1 1.2 ].3 ~4 15 zs 17 18 I.9 20 21 22 23 24 25 26 AN ORDINANCE OF THE BORRD OF SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, CALLING AND PROVIDING FOR A SPECIAL COUNTY CHARTER ELECTION FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF SAID COUNTY THE PROPOSITION OF WHETHER OR NOT AN AMENDMENT TO THE CHARTER OF THE COUNTY OF BUTTE SHOULD BE APPROVED; FIXING THE DATE OF SAID ELECTION AND THE MANNER OF HOLDING THE SAME AND THE PROCEDURE FOR VOTING FOR OR AGAINST SAID AMENDMENTS; PROVIDING FOR NOTICE OF SAID ELECTION; AND CONSOLIDATING SAID SPECIAL COUNTY CHARTER AMENDMENT ELECTION WITH THE GENERAL ELECTION TO BE HELD ON NOVEMBER 2, 1976. The Board of Supervisors of the County of Butte, State of California, DOES ORDAIN as follows: Section lea}. A special election is hereby called to be held and consolidated with the General Election on November 2, 1976, for the purpose of submitting to the qualified voters of the County, the proposition of amending the Charter of the County of Butte in the follou~ing particulars: That Article XII, Section 2 of the Butte County 'i~ Charter is hereby added to read as -Follows: Whenever property has been made subject to an assessment district (or included within an assessment district} whereby the cost of improvements had been levied against property, whether by the Improvement Act of 1911, the Municipal Improvement Act of 1973, the Improvement Bond Act of 1915 or other similar acts, that property may not be zoned so as to preclude the benefit that is derived from the work completed by the assessment district. Section 1(b}. At said election said proposition shall be submitted to the qualified voters of the County in the form of the following county measure, to wit: 1 2 3 4 5 6 7 8 9 10 11 12 13 Z4 15 16 17 18 19 20 21 22 23 24 25 26 PROPOSED COEJNTY CHARTER AMENDMENT Proposed by Board of Su~~~9isors in Ordinance Na. YES Adds Section 2 of Article xII to the Butte County Charter ~ , NO Section 2~a}_. This Board does hereby submit to the qualified electors of the County at the special county charter amendment election an amendment to the Charter of the County of Butte, and hereby designates and refers to said measure in the form set forth in Section l(b) hereinafter prescribed for use at the special county charter amendment election. Section 2 b The special county charter amendment election is consolidated with the General Election and shall be held and conducted, and the votes thereat received and canvassed, and the results thereof made and the results thereof ascertained and determined as herein provided, said election shall be held as nearly as practicable in conformity with the election laws of the State of California and only qualified voters of the County may vote thereat. ', Section 2{c). The special county charter amendment election hereby called shall be and is hereby consolidated with the General Election to be held throughout the County on November 2, 1976, all as required by and pursuant to law; and the 2. 1 election precincts, polling places and voting booths shall in 2 every case be the same and there shall be only one set of 3 election officers in each of said precincts. The election 4 precincts, ballots and absentee ballots, polling places and ~ officers of election for this special county charter amendment i 6 election shall be as established for the General Election. 7 Section _2(d_). The provisions of Article 3 of Chapter g 2 of Division 4 of the Elections Code shall apply to said special 9 county charter amendment election and the County Counsel shall ~~ prepare an analyses of said county measure in the manner provided 11 in Elections Code Section 2787. ~2 Section 2(e). The returns of said election shall be 3,3 made out and signed by the election officers and shall be by 14 them deposited with the County Clerk, together with the ballots ~~ cast at said election and the said returns shall be canvassed 16 or caused to be canvassed in the same manner as provided by 17 law far General Elections. ~g Section 3. Pursuant to Government Code Sections 23722 19 and 23709, the Glerk is hereby ordered to have the proposed 24 charter amendment, as contained in Section 1(a) of this ordinance, 21 published ten (70) times on ten (10) different days in the 22 foe l owl ng named newspaper, to wit; Oroyille Mlercury Register 23 {which the Board hereby finds and declares to be a daily newspaper 24 of general circulation printed, published and circulated in the 2~ County). The first such publication shall be as soon after the 26 adoption of this. ordinance as is possible and in no event later 3. 1 than the 15th day after the enactment of this ordinance.
