HomeMy WebLinkAbout1760ORDINANCE NO. 1760 AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STAVE OF CALIFORNIA, AN "S-R-1" SUBURBAN-RESIDENTIAL) DISTRICT 1 The Board of Supervisors of the County of Butte, State 2 _. of California, under and pursuant to .Chapter 24-30 of the Butte 3 County Code, and declaring an~emergency;-DO ORDAIN as follows: 4 SECTION 1. The hereinafter described area situated in 5 the County of Butte, State of California, shall be and it is 6 hereby zoned as an "S-R-1" (Suburban-Residential) District for a 7 period of 365 days, and such area shalt be subject to the restric• 8 Lions and restricted uses and regulations hereinafter specified 9 and provided. 10 Said area so zoned being located northwest of Chico, Z1 more particularly described as follows: 12 Beginning at the most northerly corner of Lot 1 of Z3 "Evans Tract" per map of record in Map Book 3 on Page 67 of the Butte County Recorder, thence sauth- 14 westerly along the northwesterly boundaries of Lots 1, 2, 3, 4, of said "Evans Tract" and continuing 1~ southwesterly along the northwesterly boundary of Lot 13 of "Bay Tract No. l" per map of record in ~,g Map Book 1 on Page 18 to the centerline of .Bay Ave; thence northwesterly along the centerline of Bay Ave. 17 to its intersection with the south line of Sec 8, T22N, R1E, MDB&M; thence west an said south line of 18 Sec 8 to the 5W corner of said Sec $; thence south along the section line common to Sec l7 and 18; T22N, Z9 RlE, MDB&M, to Bell Road; thence westerly along Bell Rd. to Mud Creek; thence meandering northeasterly 20 along Mud Creek to the west right-of-way line of Espla- nade; thence southeasterly along said right-of-way 2Z line to the point of beginning. 22 Excepting therefrom all that property located within 660 ft, of the centerline of Bay Ave. 23 Also excepting therefrom that property described as: 24 Beginning at the NE corner of Lot 5 of "Bay ~ Tract No . 1 " per Pap recorded in Map Book Z 28 on page 42 of the Butte County Recorder; thence northwesterly along the NE boundary -1 - 1 2 3 4 fi 8 7 S 9 10 1Z 12 13 34 15 16 17 1$ 19 20 21 22 23 24 23 26 of said "Bay Tract No. l" 817.54 ft; thence N 520 13' 4D" E, 2146.61 ft; thence S 370 54' 10" E, 561 ft; thence N 52° 13' 40" E, 500 ft. to the west right-af-way line of Esplanade; thence south- easterly along the Esplanade to the most northerly corner of Lot 1 of "Evans Tract" per Map of Record in Map Boak 3 on page 67 of the Butte County Re- corder; thence southwesterly along the northwesterly line of said "Evans Tract" to the mosi* easterly corner of Lot 12 of said "Bay Tract No. 1"; thence northwesterly along the NE boundary of said Bay Tract to the point of beginning. I4 SECTIOiV 2. ftEGULATIO~ES FOR Aid "S-R-I" DISTRICT: 1,5 The following regulations shall app3y in an "S-R-1" I6 D15triCt: 17 (A) USES PERMITTED: 18 1. One single-family dwelling per parcel, not Z9 including tents, trailers, or mobile homes. ~~ 2. Accessory buildings pertinent to the permitted 21 22 u5e5. 3. The minimum lot area per dwelling unit shall not be less than one acre, the provisions of Section 24-33 notwithstanding. 5. The minimum lot width shall not be less than one hundred thirty (130) ft., the provisions of Sec- tion 24-33 notwithstanding. (B) The following uses subject to securing a use permit in each case: 1. Golf courses and country clubs. 2. Public and quasi-public uses including churches, firehouses, hospitals, parks and playgrounds, schools and public utility buildings. 3. Sales tract offices. (C) Section. 24-33 shall apply excepting lot width and 1 of area . SECTION 3, All uses of land within the district not specifically authorized and permitted are prohibited. SECTION 4. In compliance with the provisions of said Butte County Code, Chapter 24, the same is hereby amended by add- ing this ordinance in full. SECTION 5. The penalties for the violation of the zonin -4- ., 1 hereby i~posed within the district sha11 be as provided in the 2 Butte County Code, Chapter 24, this Ordinance shall from and after 3 1t5 effective date become a supplement to and part of the Butte 4 County Code, Chapter 24. 5 SECTION 6. This urgency ordinance shall take effect e immediately upon its passage, and before the expiration of fifteen 7 (15) days after its passage shall be published once with the names 8 of the members of the Board of Supervisors voting for and against ~ 9 the same in the chicfl Enterprise-Record a newspaper in 10 general circulation in the County of Butte, State of California. 11 The facts constituting the urgency on which this Ordinance is 12 based are: 13 I.
