HomeMy WebLinkAbout1761ORDINANCE N0. 1761 1 2 3 4 S 6 7 8 s to 11 12 13 14 15 16 17 18 19 2D 2I 22 23 ?4 AN INTERIP9 ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "S-R-1" (SUBURBAN-RESIDENTIAL} DISTRICT The Board of Supervisors of the County of Butte, State of California, under/and pursuant to Chapter 24-30 of the Butte County Code, and declaring an emergency, DO ORDAIN as follows: SECTION 1. The hereinafter described area situated in the County of Butte, State of California, shall be and it is here by zoned as an "S-R-1" {Suburban-Residential) District for a peri of 120 days, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located northwest of Chico, more particularly described as follows: Lots l , 2, 3 of "Bay Tract No. 2" per hiap of Record in Map Book 1 on Page 42 of the Butte County Recorder. Lots 10, ll, & 14 of "Bay Tract No. 1" per Map of Record in Map Book 1 on Page 18 of the Butte Gounty Recorder. Containing 57 acres, more or less. SECTION 2 . REGULATIONS FOR AN "S-R-I " DISTRICT: The following regulations shall apply in an "S-R-1" District: (A) USES PERMITTED: 1 , One single-farm ly dwelling per parcel , not i nc1 ud- tents, trailers or mobile homes. 2, Accessory buildings pertinent to the permitted uses. 3. Agricultural uses excepting a minimum lot area of -1 - 1 2 3 4. ~i :. 6 7 8 9. 10 zi 12 13 14 15- 16 17 18 is 20 2z 22 23 '4 43,560 sq. ft. to be devoted to residential use and the following additional requirements for each I animal kept on the premises. a) For each horse or head of cattle or swine over one year of age -eight thousand one hundred twenty-five (8,125} sq, ft. b) For.~each sheep or goat -.two thousand (2,040) sq. ft. 4. The minimum lot area per dwelling unit shall not be less than one acre, the provisions of Section 24-33 notwithstanding. 5. The minimum lot width shall not be less than one hundred thirty (130} ft., the provisions of Section 24-33 notwithstanding. (B} The following uses subject to securing a use permit in each case: 1. Golf courses and country clubs. 2. Public and quasi-public uses including churches, firehouses, hospitals., parks and playgrounds, schoo and public utility buildings. 3. Sales tract office, (C) Section 24-33 shall apply excepting lot width and 1 of area . SECTION 3. All uses of land within the district not speci- fically authorized and permitted are prohibited. SECTION 5. The penalties for the violation of the zoninc hereby imposed within the district shall be as provided in the Butte County Code, Chapter 24, this Ordinance shall from and after its effective date become a supplement to and part of the Butte County Code, Chapter 24. SECTION 6. This urgency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen {15) days after its passage shall be published once with the names of the members of the Board of Supervisors voting for and against the same i n the Chico Entex'prise-Record a newspaper i n general circulation in the County of Butte, State of California. The facts constituting the urgency on which this Ordinance is based are: 1. To protect the health, safety, and welfare of the public.
