ORDINANCE NO. 1769
AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY
OF BUTTE, STATE OF CALIFORNIA, A "TM-20" {TIMBER-
MOUNTAIN} DISTRICT
The Board of Supervisors of the County of Butte, State
of California, under and pursuant to Chapter 24-30 of the Butte
County Code, and declaring an emergency, DO ORDAIN as follows:
SECTION 1. The hereinafter described area situated in
the County of Butte, State of California, shall be and it is
hereby zoned as a "TP9-20" (Timber-Mountain} District for a period
of eight months, and such area shall be subject to the restrict-
ions and restricted uses and regulations hereinafter specified
and provided. ,
Said area so zoned being located northeast of Chico,
mare particularly described as follows:
The 52 of the NW4 of Sec. 24, T24N, R2E, MDB&M.
The southerly 495 ft. of the NEa of the Nkl4 of
SeC. 24, T24N, R2E, ~4D6&M.
The SWa of SeC. 24, T24N, R2E, MDB&M,
Containing 255 acres, more or less, Cohasset.
SECTION 2. REGULATIONS FOR A "TM-20" DISTRICT:
The following regulations shall apply in a "TM-20"
District:
{A} USES PERMITTED:
1. One single-family dwelling per parcel, including
mobile home .
2. Management, raising, harvesting and removal of
trees, shrubs, seedlings, flowers, herbs and all
food crops for human or animal consumption.
3, Keeping and raising small animals for domestic

use, including dogs, cats and household pets,
poultry and other birds, bees, fish and frogs,
4. Keeping, raising and pasturing of cattle, horses,
sheep, goats, hags or other livestock, provided
that no more than two (2} such animals be kept per
acre on parcels of less than five {5} acres and no
more than four {4} such animals be kept per acre on
parcels of five {5) acres or more.
5, Prospecting, claiming, drilling, mining, excavating
and dredging of mineral, hydrocarbon and geothermal
resources, except as limited in Section {B) below,
6, Protection of land and forests fi^om fire, erosion,
floods, slides, quakes, insects, diseases and
pollution, including arboretums and natural wilder-
ness, experimental and study areas.

{B.) USES PERMITTED SUBJECT TO FIRST SECURING A USE
PERMIT III EACH CASE:
1. Residential uses other than one single-family
dwelling per parcel or one single family dwelling

4 2. Commercial wood processing plants.
5 3, Commercial kennels and animal hospitals.

g might be objectionable by reason of noise, odor,
10 smoke, dust, bright light, vibration, stream
11 pollution or handling of explosives or dangerous
12 materials.

13 7. Commercial boat ramps, docks and landing facilities,
14 $. Aircraft landing facilities.
15 9. Disposal areas and sewage treatment facilities.
16 10. Public and quasi-public uses including schools,
17 parks, playgrounds, recreational facilities, utility
18 system structures, meeting halls, hospitals,
19 libraries, museums, government offices and similar

2Z ll. Private or commercial outdoor recreation facilities
22 on sites of not less than five {5) acres, including
23 country clubs, golf courses, riding academies and
24 stables, hunting and fishing camps and other clubs,

Minimum required area of a lot per dwelling unit
shall not be less than twenty (20) acres for "TM-20"
{p} LOT ~iIDTH REQUIRED:
P~inimum required lot width shall not be less than
sixty-five (fi5 ) feet .
(E) FRONT YARD REQUIRED:
Minimum required front building setback shall be
not less than fifty {50) feet from the centerlines
of the road, except where the road is classified by
the County as a Federal Aid Secondary Road, the
minimum required front building setback shall be
not less than fifty-five (55) feet from the center-
line of the road.
(F) SIDE YARD REQUIRED:
Minimum required side building setback shall be not
less than twenty-five (25} feet for "TM-20".
(G) REAR YARD REQUIRED:
Minimum required rear building setback shall be not
less than fifty {5O} feet for "TM-20".
SECTION 3. All uses of land within the district not
specifically authorized and permitted are prohibited.
SECTION 4. In compliance with the provisions of said
Butte County Code, Chapter 24, the same is hereby amended by
adding this Ordinance in full,
SECTIONS. The penalties for the violation of the
zoning hereby imposed within the district shall be as provided

in the Butte County Cade, Chapter 24, this Ordinance shall from
and after its effective date become a supplement to and part of
the Butte County Code, Chapter 24.
SECTION 6. This urgency ordinance shall take effect
immediately upon its passage, and before the expiration of fifteen
(15) days after its passage shall be published once with the names
of the members of the Board of Supervisors voting for and against
the Same In the Chico En~erpxise Record a newspaper in general
circulation in the County of Butte, State of California. The
facts constituting the urgency on which this Ordinance is based
are:
1. Further division would not be in the public
interest and permanent zoning for this area has
been proposed.
PASSED AND ADOPTED by the Board of Supervisors of the
County of Butte, State of California, on the 23rd day of
November, 1976, by the fallowing vote:
