HomeMy WebLinkAbout1792ORDINANCE NO. x.792 AN ORDINAk~tCE ZONING A PORTION OF THE COf1NTY OF BUTTE, STATE Ol= CALIFORNIA, A "C-2" (GENERAL COMPIERCIAL) DISTRICT, PURSUANT TO CHAPTER 24--29. 1 The Board of Supervisors of the County of k3utte, State 2 of California, under and pursuant to Chapter 24-29 of the butte 3 County Code of said County DO ORDAIN as fo17o-vs: 4 SECTION 1. The hereinafter described area situated in ~ the County of Butte, State of California, shall be and it is 6 hereby zoned as a "C-2" {General Commercial) District, and such 7 area shall be subject to the restrictions and restricted uses $ and regulations hereinafter specified and provided. 9 Said area so zoned being located in the unincorporated 10 area of Butte County, Oroville, mare particularly described as I1 follows: 12 Ali that property located south of Oroville- Bangor Hwy and east of Lower Wyandotte Road, 13 and bounded an the south and east by the fallowing described line: 14 Commencing at tkte SW corner of Lot 1 of Block 3O 1S of "Viiia..Verona Sub" per ~~lap of Record Wall Map No. l2 in the Office of the k3utte County Retarder; 16 ~~ thence north along the west line of said Lot 1, 367.78 ft. to the true poi~h~~ of be inning of the 17 herein described line; thence S 83~ 14' 25" E. 18 332.3 ft. to the east line of said Lot 1; thence north along said east line of Lot~l and its 19 northerly prolongation to the south right-of-way line of Oroville Bangor Hwy and the end of the 20 herein described line. 21 Containing i.7i acre, more or less. 22 SECTION 2. REGULATIONS FOR A "C-2" DISTRICT: 23 The fallowing regulations shall apply in a "C-2" 24 District. 23 (A) USES PERP~kITTED; 26 1. General commercial uses including art shops, aviaries, bar and coc[ctail lounges, billiard parlors and pool halls, bowling alleys, building material {retail}, cleaning and pressing establish- ments, dance halls, interior decorating shops, employment agencies, governmental legislative build- ings, gymnasiums, public, commercial or physical cultural studios, hospitals, hotels and motels, laboratories and x-ray facilities, massage parlors and reducing salons, equipment rentals, pet shops, used car lots, repair garages, auto car washes, plumbing shops, cabinet shops, sign manufacturing shops, and other retail establishments when interpreted as si mi 1 ar , 4. Public or quasi-public uses including churches. 4. Service stations, drive-in restaurants, kennels and small animal hospitals and mortdaries. (C) THE REQUIREMEt~ITS OF SECTIOhI 24-33 OF THIS GODS ARE f~ODIFIED FOR ALL BUILDI~EG SITES Ill C-2 ZO~EE: I~ THE ~'OLLOWIIVG PARTICULARS: 1. Lot width required. Minimum lot width shall not be less than twenty five (25) feet. The lot width requirements for residential dwellings shall conform to the requirements for any residential zone. 2. Side yard requirements. [done, except where the side of a lot abuts upon the side of a lot in an "R" District, in which case the abutting side yard shall not b.e less than five (5.) feet; and except where the side yard on the street side of a corner lot abuts on an "R" District, in which-case the side yard on the street side shall bE one-half the front yard required in such "R" Districts. The side yard requirements for residential dwelling shall conform to the requirements for any residential zone. 3. Rear yard required. All uses of land vrithin the district not specifically authorized and permitted are prohibited. SECTIO(d 4.. In cam fiance with the _. p provisions of said Butte County Code, Chapter 24, the same is hereby amended by adding this Ordinance in full. 5ECTI0N 5. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Butte County Cade, Chapter 24, this Ordinance shall from and after its effective date become a supplement to and part of the Butte County Cade, Chapter 24. SECTIO(V 5. This Ordinance sha11 be and it is hereby declared to be in full force and effect from and after thirty (30) days after the date of its passage, and before the expiration of fifteen t1S} days after its passage, this Ordinance shall be published once with the names of the members of the Board of 5uper.visvrs voting for and against it in th.e Orovil~.e Mercury a newspaper published in the County of Butte, State of California.
