That §2-72 of the Butte County Code is hereby amended to read as follows: Section 2-72. Meetings and Actions. The Planning Commission shah. hold at least one regular meeting each month. A majority of the members of the Commission constitute a quorum for the transaction :of bus.inessc.;:. No act of the Commission shall be valid or binding unless approved by a majority of the members present. A tie vote shall be deemed to be a denial of the relief applied for. Section 2. This urgency ordinance shall take effect iimmediately upon its passage, and before the expiration of fifteen ', (15) days after its passage shall be published once with the zzames of the members of the Board of Supervisors voting far and against the same in the Biggs News a newspaper in general circulation in the County of Butte, State of California. The facts constituting the urgency on which this ordinance is based are: 1. Tiie present section requires a majority vote by all members of the Planning Commission. When less than all the members are present, acton:_,.on many projects has to be continued because the Planning Commission is unable to obtain a majority vote of all the members. The County of Butte is, pursuant to an Action No. 14553, filed in the County of Colusa, required to cample I~ -- 1 and adopt the seismi~~safety, safety, noise, and scenic::=.highway 2 elements of the General Plan by March 15, 1977. The Board of 3 Supervisors has requested the Planning Commission to meet on 4 Thursday evening, March 3, 1977, to review proposed modifications 5 to the proposed elements and make a report back to the Board of 6 Supervisors with their recommendations by March 8, 1977. Only 7 seven of the nine members of the Planning Commi.ssi.an wi11 be 8 present for the hearing on March 3, 1977. Unless a majority of 9 all members were to make recommendations on the proposed modifica- 10 Lions, a report could not be sent back to the Board of Supervisors 11 by March S, 1.977. If the Board of Supervisors do not receive the:- 12 report back by March 8, 1977,-the Board of Supervisors may not be 13 able to complete hearing and adopting the four elements by 14 March 15, 1977, 15 PASSED AND ADOPTED by the Butte County Baard of Super- 16 visors cin 1st day of March, 1977, by the following vote: 17 AYES: Supervisors Lemke, Madigan, Moseley and Chairman Richter 1$ NOES : Supervisor Winston 19 ABSENT : None 20 NOT VOTYNC : None 21 BERNARD D.
