Resolution No. 18-007"
RESOLUTION CREATING THE CLASSIFICATION OF DESIGNATED LEVEL 1 RESERVE DEPUTY SHERIFF
WHEREAS, Penal Code section 830.6(a)(1) provides that whenever any qualified person is deputizedor appointed
by the proper authority as a reserve deputy sheriff, and is assigned specific police functions by that authority,the person
is a Level 1 Reserve Deputy, whose peace officer powers only extend for the duration of the deputy's specific assignment;
and
WHEREAS, Penal Code section 830.6(a)(2) provides that, by resolution,a County Board of Supervisors may create
a Designated Level 1 Reserve Deputy classification, and whenever any qualified person is deputized or appointed as a
Designated Level 1 Reserve Deputy by the proper authority,and is assigned to the prevention and detection of crime,and
the general enforcement of the laws of this state, that person is a Designated Level 1 Reserve Deputy, who shall have
peace officer powers 24-hours a day; and
WHEREAS, due to the unfortunate increase in violent crime and the random occurrence of active shooter
situations in both rural and urban areas across the nation, the citizens of Butte County would benefit from having
additional qualified, trained and armed deputies available on a 24 hour a day basis; and
WHEREAS, in accordance with the Penal Cade sections summarized above,the Sheriff is requesting that the Board
of supervisors create the classification of Designated Level 1 Reserve Deputy, and authorize the Sheriff to appoint certain
Level 1 Reserve Deputies to the classification of Designated Level 1 Reserve Deputies,on a case by case basis,which would
give those designated reserve deputies full peace officer powers at all times, allow them to be armed while off duty, and
allow them to take law enforcement action, if and when appropriate, to protect themselves and others.
NOW,THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby:
1. Creates the classification of"Designated Level 1 Reserve Deputy Sheriff";and
2.. Authorizes the Butte County Sheriff, or his or her designated representative,to
appoint to that classification, on a case by case basis, qualified Level 1 reserve
deputies.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 91' day of January, 2018, by the following
vote:
AYES: Supervisors Wahl, Kirk, Connelly,Teeter, and Chair Lambert
