Resolution No. 18-030
RESOLUTION TO ACCEPT AND RECORD A QUITCLAIM DEED FROM THERMALITO WATER AND SEWER DISTRICT
THAT PARTIALLY EXTINGUISHES A RESERVATION IN A RECORDED DEED AFFECTING A PORTION OF COUNTY OWNED
REAL PROPERTY WITHIN THE OROVILLE GOVERNMENT CENTER CAMPUS
WHEREAS, on August 11, 2015, the Board of Supervisors of the County of Butte (Board of Supervisors) adopted
Resolution. No. 15-106, authorizing the submission of an application for funding of the Jail Program, Inmate Treatment,
Capacity and Replacement Housing Project (Project) under the Senate Bill 863 Financing Program (SB 863); and
WHEREAS, the County of Butte (County) received conditional approval from the Board of State and Community
Corrections (BSCC)on [December 17, 2015,. for an award in accordance with SB 863 for partial funding of the Project in the
amouint of$40 million, subject to the State Public Works Board (SPWB) approval process which included real estate due
diligence for the proposed Project site as well as the greater parcel as described in the apiplication documents; and
WHEREAS, SPWB review of the title documents for the Project site as well as the greater parcel revealed a
reservation in a Deed from Thermalito Water and Sewer District (TWSD) to the County, recorded on January 11, 1960 in
Book 1038 at Pages 142-145 of the Official Records of the County of Butte (Deed)that directly impacts a portion of County
owned real property identified as Assessor's Parcel Number 031-020-039 and 031-040-020 (Subject Parcels) that could
adversely affect the beneficial use and quiet enjoyment of the proposed Project site; and
WHEREAS, the recommendation by the SPWB for mitigation of the reservation contained in the Deed covering
the Subject Parcels was the recordation of a Quitclaim Deed from TWSD to the County which would specifically release
any and all right, title, and interest reserved by TWSD for rights of way or easements for constructing any future ditches
or pipelines while existing rights of way and easements for irrigation or drainage ditches and pipelines would not be
affected (Quitclaim Deed), and
WHEREAS, TWSD in support of the County and the Project have agreed to the execution and recordation of the
aforementioned Quitclaim Deed.
NOW,THEREFORE,BE IT RESOLVED that the Board of Supervisors hereby finds that it is in the best interest of the
citizens of the County to approve,accept, and record the Quitclaim geed from TWSD to partially extinguish the reservation
contained in the Deed affecting County owned real property and authorize the General Services Director on behalf of the
County of Butte and the Board of Supervisors to execute any and all documents necessary to effect the recordation of the
Quitclaim Deed, including the Certificate of Acceptance.
