RESOLUTION TO ACCEPT AND RECORD A QUITCLAIM DEED FROM THERMALITG WATER AND SEWER DISTRICT
THAT EXTINGUISHES RESERVATIONS IN A RECORDED DEED AFFECTING A PORTION OF COUNTY OWNED REAL
PROPERTY WITHIN THE OROVILLE GOVERNMENT CENTER CAMPUS
WHEREAS,on August 22,2017,. the Board of Supervisors of the County of Butte("Board of Supervisors"),approved
the Butte County Capital Improvement Program ("CIP") for Fiscal Years 2017'-18 through 2026-27, which is a budgeting
plan for the County's service and transportation infrastructure improvements for the next ten years; and
WHEREAS, included in the CIP is the construction of a new Evidence Storage Building&Morgue facility("Project"),
which would require debt financing for a portion of the total design and construction costs; and
WHEREAS, review of the title documents for the Project revealed reservations in a Deed from'Thermalito Water
and Sewer District("TWSD") to Ernest C. Putnam Et Ux, recorded on February 11, 1941, as Book 258 at Pages 287-.290, of
the Official Records of the County of Butte ("Deed"), that directly impacts a portion of County owned real property
identified as Assessor's Parcel Number 031-040-028 ("Subject Parcel"), that could adversely affect the beneficial) use and
quiet enjoyment of the proposed Project site and the County's ability to finance a project on the site; and
WHEREAS, TWSD in support of the County and the Project have agreed to the execution and recordation of a
Quitclaim Deed which would specifically release any and all right,title, and interest reserved by TWSD for rights of way or
easements for existing roads,ditches,canals, drains, pipes or other purposes,together with the reservation for any rights
of way or easements for the purposes of hereafter constructing, maintaining and operating any irrigation ditch, drainage
ditch, and/or pipe line and to flow therein.
NOW,THEREFORE, BE IT RESOLVED that the Board of Supervisors, hereby finds that it is in the best interest of
the citizens of the County to approve, accept, and record the Quitclaim Deed from TWSD to extinguish the reservations
contained in the Deed affecting County owned real property and authorize the General Services Director on behalf of the
County of Butte and the Board of Supervisors, to execute any and all documents necessary to effect the recordation of
the Quitclaim Deed, including the Certificate of Acceptance.

vote:
