HomeMy WebLinkAbout1804ORDINANCE N0. 180 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, PURSUANT TO CHAPTER 24-29 OF THE BUTTE COUNTY CODE. 1 PURPOSE OF CLASSIFICATION. The Baard of Supervisors 2 finds and determines that: 3 1. The Mobile Home, as a residence, is an accepted mode 4 of living which offers certain advantages and attractions to 5 segments of the public. g 2. The development and operation of Mobile Home Parks, 7 as related to adjacent areas, deserve special consideration. g Therefore, the purpose of this Ordinance is to permit areas fer g Mobile Home Parks in pleasant, residential surroundings, properly 10 integrated with adjacent neighborhoods, to the optimum benefit of 11 residents of the Mobile Home Park and of the greater community. 12 The Baard of Supervisors of the County of Butte, State 13 of California, under and pursuant to Chapter 24-29 of the Butte 14 County Code of said County DOES ORDAIN as follows: 3.5 SECTION 1. The hereinbelow described area, situated in 16 the County of Butte, State of California, shall be and is hereby 17 zoned as an MHP {Mobile Home Park) District and such area shall be 18 subject to the restrictions and restricted uses and regulations 19 hereinafter specified and provided, said area so zoned being 20 located near Chico, California, and more particularly described 21 as follows: 22 Lots 15 through 30 and Lats 43 through 53 of that Map titled "Revised Tentative Map of Park 23 Commons Subdivision" a~i file in the Office of 24 the Butte County Planning Department described as: 28 Beginning at the northwesterly corner of Lot 27 of "Hobart Sub" per Map of Record in Map Book 4 26 an Page 24 of the Butte County Recorder, also being the intersection of the centerlines of -l - ~ 1 Morseman Ave, and Lassen Ave.; thence N 53° 12' E 351 ft.; thence S 36° 4$' E ZSO ft.; 2 thence N 53° l2' E 6S ft.; thence S 3b° 48' E to the northerly prolongation of the westerly 3 right-of-way Line of ~4ihite Ave.; thence southerly along said right-of-way Line 170 ft. to the 4 southerly boundary of Lot 28 of said "Hobart Sub"; thence westerly 295.34 f t. to the south- g westerly corner of said Lot 28; thence naxth- westerly along the westerly boundary of said Q lots 27 and 28 to the point of beginning. 7 Containing 12.b7 acres, more ar less, Chico. g SECTION 2. APPLICATION OF REGULATIONS. The regulations 9 of this Ordinance sha11 apply in all Mobile Home Park Districts. 10 (A} USES PERMITTED: The fallowing uses subject to 11 securing an approval by the Planning Department of a 12 A~laster Development Plan: 13 1. Principal uses 14 (a) Mobile homes containing not less than 500 15 square feet of gxoss area. 16 2. Accessory uses: Subject ,~a appropriate conditions, 17 the following accessory uses may be approved, as a part 18 of the Master Development Plan, in any Mobile Home Park: 19 (a) Management office and maintenance equipment 20 storage. 21 (b} Coin operated laundry and ,dry cleaning 22 facilities, for residents only. 23 (c) Vending machines, for residents only. 24 {d) Non-commercial recreation, meeting halls, 2S clubhouses, swimming pools, etc. 2B .. (h) Other uses which are clearly incidental and subordinate to the principal use. (B) STANDARDS POR MOBILE HOMES AND ACCESSORY USES. 1. Minimum site area: 10 contiguous acres, 2. Maximum density: The density, determined by the Master Development Plan approval, shall not exceed the following: Ten Mobile Homes of 750 square feet in gross area per acre; ox a combination thereof. 3. Prior to occupancy of the first Mobile Home, not less than 50 Mobile Home lots shall be prepared and available for occupancy. 4. Parking requirements: The overall parking ratio shall be two parking spaces (10' x 20') per Mobile Home lot. At least one parking space shall be provided on or immediately adjacent to each Mobile Home lot. 5. Building lines: All stru ctures and Mobile Homes shall. have a setback of at least 25 feet from all property lines and any street or road right-of-fray adjoining the Mobile Home Park. The setback area shall be landscaped and maintained as a buffer strip, and in all cases the setback area shall be in conformity with Butte County Gode - Chapter 10, Article II. b, Signs: Each A4obile Home Park shall have a bulletin for the listing of each Mobile Home site and the name of -3- 1 2 3 4 5 6 7 8 9 la 11. 12 13 Z4 15 16 17 1$ 19 20 2I 22 23 24 2S 2a the occupant thereof. The bulletin board shall be located outside the office and shall be lighted at night. Adequate signs and marking indicating directions, parking areas, recreation areas and street names shad, be established and maintained in the Mobile Home Park, Such signs shall not exceed six (b) square feet in area. Signs, or name plates not exceeding two{2} square feet in area and displaying the name and address only of the occupant of the Mobile Home may be erected at each Mobile Home site. Signs which identify or advertise the Mobile Home Park may be erected if approved by the Planning Department in its action on the A4aster Development Plan for.the Mobile Home Park. Such signs must be located on the premises and shall be not more than one hundred twenty {1Z0} square feet in area. They shall not be animated or illuminated except by indirect non-flashing light. 7. Utilities: All:utiliti~s shall be installed underground. (C) PROPERTY DE'4TELOPMENT STANDARDS . The following development standards shall apply to the individual Mobile Home sites. Plans and elevations for the Mobile Home Park shall be submitted along with other construction plans with the Master Development Plan for a Mobile Home Park, and shall be subject to review and change upon recommendation of the Planning Department. -4- 1 1. Mobile Home Site Area. The Mobile Home sites i.n a 2 rlobile Home Park sha11 average 3000 feet in area, but no 3 site shall be smaller than 2700 square feet. 4 2. Mobile Home Site Width. Each Mobile Home site 5 designed for a single Mobile Home shall be of an average g width of 42 feet. Sites designed for a double width ox 7 larger shall be of an average width of 30 feet plus the g width of the Mobile Home, unless it can be shown that 9 adequate space for a patio, parking, and side yards will lp be assured, despite a site of less width. 11 3. Mobile Home Site Frontage. Each Mobile biome site ~2 shall abut directly upon a Mobile Home Park street for a 13 minimum distance of thixty (30) feet. 14 4. Population Density. Not more than one single-family ].5 Mobile Home may be placed on a Mobile Home site. 16 5. Landscaping. The following landscaping provisions 17 shall apply in all Mobile Home Parks. 18 (a) All open spaces except driveways, parking areas ~9 walkways, utility areas, improved decks, patios 20 or porches shall be maintained with landscaping 21 (D} SPECIAL DEVELOPMENT STANDARDS. 22 1. Walls and fences: Walls and fences on individual 23 Mobile Home sites shall not exceed two (2) feet in 24 height. Walls or fences shall be erected around the ZS perimeter of each Mobile Home Park as may be required by 26 the Planning Department. Mobile Home Park streets: Mobile Home Park streets sha11 be provided in such a pattern as to provide con- venient traffic circulation within the Mobile Home Park. They shall be constructed to the following standards: (a) All Mobile Home Park streets sha11 have a width of not less than 3~ feet including curbs. {b) There shall be concrete rolled curbs on each side of the streets. {c) The Mobile Home Park streets shall be paved in conformity to Butte County standards. (d) The Mobile Home Park streets shall have adequate lighting. (e) Drainage facilities and encroachment to public roads shall be in conformity with the Butte County Department of Public ~'~orks standards. (E) RECREATION AREAS. A central recreation area shall be established in each Mobile Hame Park created pursuant to the, provisions of this article. The size of such area shall be at least two hundred (2D0) square feet per Mobile Hame site. The xecreatian area may contain community clubhouses, szaimming gaols, shuffleboard courts and similar facil- ities. The Planning Department may permit decentral- ization of the recreational facilities in accordance _~_ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 ~~ 'I 18 19 20 21 22 23 24 25 28 with principles of good planning provided that the total recreation area meets the above stated minimum size. (F) MOBILE HOME PARK OFFICE. Every Mobile Home Park shall include a permanent building for office use. Such building may include a single- family dwelling for the exclusive use of the owner ar manager. (G) LAUNDRY ROOMS. Every Mobile Home Park shall have one or more laundry rooms. Laundry drying lines shall not be permitted on any Mobile Hame site. (H) MAIL BOXES PROVIDED, Each Mobile Home site shall be equipped with a recep- acie for mail deliveries in accordance with acceptable standards of the United States Post Office Department. (I) TELEPHONES. The Mobile Home Park shall contain at least one (1) public telephone for the use of park residents. (J) STORAGE AREAS. Areas used far storage of travel trailers, boats and other such items, may be established in a Mobile Home Park provided they are adequately screened from public view. (K) UTILITIES . The ownex is respon- sible for complying with the requirements of this sectio and he shall make the necessary arrangements with each o the serving utilities for the installation of such facil ities, Transformers, terminal boxes, meter cabinets, pedestals-, concealed ducts, and other facilities necess- ary appurtenant to such underground facilities shall be installed in conformance with specifications of the State of California Department of Housing and Community Development - Division of Building and Housing Standards, {L) COMMUNITY TELEVISION ANTENNA. Individual rooftop or outdoor television antennas shall not be permitted in a Mobile Home Park. One single television antenna for community sexvice may he situated within the Mobile Home Park. {M) DOGS AND ANIMALS. Dogs and other household pets shall not be permitted to run at large in any Mobile Home Park. Bird aviaries, poultry and other barnyard animals shall not be permitte+ in any Mobile Home Park. {N) TRANSIENT SPACES. Not mare than ten {10) per cent of the Mobile Home sites may be used-far transient Mobile Home sites, Sites reserved to transient Mobile Homes shall be so desig- Hated on the plans submitted with the Master Development Plan.
