Resolution No. 18-049
RESOLUTION GIVING NOTICE OF HEARING TO VACATE UNNECESSARY PUBLIC RIGHTS OF WAY IN THE PALERMO AREA
WHEREAS,this Board has received a request for vacation of a portion of public rights of way as described below;
and
WHEREAS, the Planning Commission has considered this vacation, and found the request consistent with the
Butte County General Plan; and
WHEREAS,this Board initiates a proceeding to vacate a portion of a public right of way as described in the attached
Exhibit A and shown on the attached Exhibit B; and
WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of California Streets and Highways Code (commencing
with section 8320)this Board shall set a date, hour, and place for a hearing on the request for vacation.
NOW,THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby:
1. Gives notice that at its regular meeting on April 24, 2018, at 9:20 a.m., in the Board Chambers, Butte County
Administration Building, 25 County Center Drive, Oroville California, a (hearing shall be held to hear all persons
interested in the vacation of that certain portion of public right of way in the Fulton Avenue area of Palermo. The
street to be vacated is as follows:
• The portion of Fulton Avenue between Baldwin Avenue and Esperanza Avenue.
In the County of Butte, State of California, more particularly described in the attached Exhibit A, and shown on
the attached Exhibit B.
2. That a map showing the public right of way to be vacated is on file in the Office of the Butte County Department
of Public Works, 7 County Center Drive, Oroville, California 95965.
3. That at the conclusion of said hearing,the Board intends to vacate said public right of way.
4. That this vacation proceeding is being conducted pursuant to Chapter 3 of Part 3 of Division 9 of the California
Streets and Highways Code (commencing with section 8320).
5. That this resolution be posted and published pursuant to the provisions of Chapter 3 of Part 3 of Division 9 of the
California Streets and Highways Code.

vote:

ABANDONMENT DESCRIPTION
All that real property situate in the County of Butte, State of California, being more
particularly described as follows:
A portion of Fulton Avenue between Baldwin Avenue and Esperanza Avenue as shown
on the map entitled "Palermo Citrus Tract Subdivision #1", being Wall Map #3 and filed
in the Office of the Recorder, County of Butte, State of California, on February 17, 1891
in Book 5 of Maps at page 4, being a portion of Section 8, Township 18 North, Range 4
East, M.D.B.&M., and being more particularly described as follows:
Beginning at the Northeast corner of Lot 32 in Block 41 as shown on said Subdivision
Map, which point is at the intersection of the South right of way line of Baldwin Avenue
and the West right of way line of Fulton Avenue; thence leaving the Point of Beginning
and running Southerly 300.00 feet along the West right of way line of Fulton Avenue
and the East line of Block 41 to the Southeast corner of Lot 21 in Block 41 as shown on
said Subdivision Map, which point is at the intersection of the North line of Esperanza
Avenue and the West line of Fulton Avenue; thence Easterly 80.00 feet along the North
right of way line of Esperanza Avenue to the Southwest corner of Lot 12 in Block 44 as
shown on said Subdivision Map, which point is at the intersection of the North right of
way line of Esperanza Avenue and the East right of way line of Fulton Avenue; thence
Northerly 300.00 feet along the East right of way line of Fulton Avenue and the West
line of Block 44 to the Northwest comer of Lot 1 in Block 44 as shown on said
Subdivision Map, which point is at the intersection of the South line of Baldwin Avenue
and the East line of Fulton Avenue; thence Westerly 80.00 feet along the South right of
way line of Baldwin Avenue to the Southeast corner of Lot 32 in Block 41 as shown on
said Subdivision Map and the Point of Beginning.
