D ;. � r. ii i -r'� 1i,r/,.,, �If .ji��i ./��////r✓,i„ !r✓.v,. ,..,.,. , r,,, -.f / ,li/, � ,i l iii, ,r, i,.. a .,,, r ,. /,,;. a, i. ,.,,/.. i/ „/, �r/,' r r ir..e. r ' ;,J!t, / ,,.:. e. ,.�� ;, ,i �. i ✓,. r. i ,.../ ,r.,, i..i .; , � ...,r,. /i. r.... rf Resolution No. 18-066 RESOLUTION ABANDONING PUBLIC RIGHTS OF WAY ALONG PORTIONS OF' FU'LTON AVENUE IN THE PALERMO AREA WHEREAS, this matter canoe on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, on April 24, 2018, in the Board Chambers, Butte County Administration Building, 25 County Center Drive, ©iroville, California; and WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of the public right of way in question was duly and regularly given as required by law; and WHEREAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that: (1)there is no possibility the proposed abandonment of this public right of way may have a significant effect on the environment, and it is therefore not subject to the California Environmental Act; (2) the proposed abandonment is in conformance with the (Butte County General Plan, and (3) the public right of way in question, as hereinafter described is unnecessary for present or prospective public use. NOW,THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors: 1. That the public right of way situated in the County of Butte, State of California, as hereinafter more particularly described, is hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways code (commencing with Section 8320). 2. That said public right of way so abandoned is located in the unincorporated area of the County of Butte, State of California, in the Palermo area. The street is more particularly identified as follows: e The portion of Fulton Avenue between Baldwin Avenue and Esperanza Avenue, 3. That the area to be abandoned is more particularly described in the Attached Exhibit A, and shown on the Attached Exhibit B. 4. That a public utility easement shall be established over the former street right of way for use of both underground and overhead public utilities. 5. That a map showing the right of way hereby abandoned is on file in the Office of the Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 6. That the clerk of this Board shall cause a certified copy of this resolution, with the seal of the Board of supervisors of the County of Butte, State of California, to be recorded in the Office of the Recorder of the County of Butte, State of California. PASSED AND ADOPTED by the Butte County Board of Supervisors this 24th day of April, 2018, by the following vote: AYES: Supervisors Connelly, Wahl, Kirk, Teeter, and Chair Lambert NOES: None ABSENT: None NOT VOTING: None Steve LambqV, Chair Butte County Board of Supervisors ATTEST: Shari McCracken, Interim Chief Administrative Officer and Clerk of the Board of Supervisors By: Repot EXHIBIT "A" ABANDONMENT DESCRIPTION All that real property situate in the County of Butte, State of California, being more particularly described as follows: A portion of Fulton Avenue between Baldwin Avenue and Esperanza Avenue as shown on the map entitled "Palermo Citrus Tract Subdivision #1", being Wall Map#3 and filed in the Office of the Recorder, County of Butte, State of California, on February 17, 1891 in Book 5 of Maps at page 4, being a portion of Section 8, Township 18 North, Range 4 East, M.D.B.&M.,, and being more particularly described as follows: Beginning at the Northeast corner of Lot 3,2 in Block 41 as shown on said Subdivision Map, which point is at the intersection of the South right of way line of Baldwin Avenue and the West right of way line of Fulton, Avenue; thence leaving the Point of Beginning and running Southerly 300.00 feet along the West right of way line of Fulton Avenue and the East line of Block 41 to the Southeast corner of Lot 21 in Block 41 as shown on said Subdivision Map, which point is at the intersection of the North line of Esperanza Avenue and the West line of Fulton Avenue; thence Easterly 80.00 feet along the North, right of way line of Esperanza Avenue to the Southwest corner of Lot 12 in Block 44 as shown on said Subdivision Map, which point is at the intersection of the North right of way line of Esperanza Avenue and the East right of way line of Fulton Avenue; thence Northerly 300.00 feet along the East right of way line of Fulton Avenue and the West line of Block 44 to the Northwest corner of Lot 1 in Block 44 as shown on said Subdivision Map, which point is at the intersection of the South line of Baldwin Avenue and the East line of Fulton Avenue; thence Westerly 80,010 feet along, the South right of way line of Baldwin Avenue to the Northeast corner of Lot 32 in Block 41 as shown on said Subdivision Map and the Point of Beginning. RESERVING THEREFROM a Public Utility easement across the area described above, being all of Fulton Avenue between Baldwin Avenue and Esperanza Avenue which, is, 80.00 feet wide, (East and West) by 300.00 feet long, (North and South).
