Resolution No. 18-115
DESIGNATE BUTTE COUNTY JAIL AS TREATMENT FACILITY
WHEREAS, Senate Bill (SB) 568 amends California Penal Code Sections 1369 and 1369.1 to address the
problem of the inability of local jails in California to adequately medicate inmates found Incompetent to 'Stand Trial
(IST) and who remain in local custody; and
WHEREAS, California Penal Code Section 1369.1 allows countyjails,to be designated as "treatment facilities”
for the scale purpose of administering antipsychotic medication to persons found Incompetent to Stand Trial) pursuant
to a court order; and
WHEREAS, California Penal Code Section 1369.1 requires concurrence among the County Board of
Supervisors, the County Behavioral Health Director, and the County Sheriff for the county jails to be designated as
"treatment facilities” to provide medically approved medication to defendants found to be mentally incompetent
and unable to provide informed consent due to a mental) disorder..
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors, Butte County Sheriff, and
the Butte County Behavioral Health Director hereby concur that the County of Butte jail be and hereby is designated
as a "treatment facility”to provide medically approved medication to defendants found to be mentally incompetent
and unable to provide informed consent due to a mental disorder, pursuant to the provisions of the California Penal
Code Section 1369.1.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 101 day of August, 2018, by the
following vote:
AYES: Supervisors Connelly, Wahl, Kirk,Teeter, and Chair Lambert
