HomeMy WebLinkAbout1812ORpiNANCE N0. 1g~.2 AN .INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY OE BUTTE, STATE OF CALIFORNIA, AN "5-Rwl" {SUBURBAN-RESIDENTIAL) DISTRICT ~, The Board of Supervisors of the County of Butte, State 2 of California, under and pursuant to Chapter 24-30 of the Butte 3 County Code, and declaring an emergency, DO ORDAIN as follows: 4 SECTION 1. The hereinafter described area situated in 5 the County of Butte, State of California, shall be and it is g hereby zaned as an "S-R M1" (Suburban-Residential} District for a q period of 12O days, and such area shall be subject to the restric- g tions and restricted uses and regulations hereinafter specified 9 and provided. Zp Said area so zoned being located in the unincorporated 11 area of Butte County, Chico, more particularly described as 12 follows: 13 That portion of the S2 of Sec. 4, 1'22N, R1E, MDB&M located west of Hicks Lane. Z4 That portion of the t~12 of Sec. 9, T22N, Rl E, ~~ MDB&M located north of Parcel 2 of that parcel map recorded in Map Book 55 on Pages 97 and 98 ~6 of the Butte County Recorder, and east of State Hwy 99. ~7 That portion of the NW4 of the NEB of Sec. 9, 18 T22N, R1E, MDB&M located south and west of Sycamore Creek. 19 Lots 5 through 12, 20, 21, 22, 23, 34, and 35 20 and the Ez of lot 33 of"Hobart Sub" per Map of Record in Map Book 4 on page 24 of the Butte Gount,y 23. REGUtATIONS FOR AN "S-R-1° DISTRICT: The fallowing regulations shall..apply in an "S-R-l" District: (A) USES PERMITTED: 1. One single-family dwelling per parcel, not including tents, trailers, or mobile homes. 2. Accessory buildings pertinent to the permitted uses. 3. Agricultural uses excepting a minimum lot area of 43,560 sq. ft. to be devoted to residential use and the following additional requirements for each animal kept on the premises. (a) For each horse or head of cattle ar swine over one year of age - eight thousand one hundred twenty-five (8,125} sq, ft. (b} For each sheep or goat -two thousand (2,000} sq . ft. 4~. The minimum lot area per dwelling unit shall not be less than one acre, the provisions of Section 24-33 notwithstanding. 5. .The minimum lot width shall not be less than one hundred thirty (l 3O} ft., the provisions of Section 24-33 notwithstanding. Public and quasi-public uses including churches, f_rehauses, hospitals.,.parks and playgrounds, schools and public utility buildings. 3. Sales tract offices. (C) SECTION 24-33 SHALL APPLY EXCEPTING LOT WIDTH AND LOT AREA. SECTION 3. All uses of land within the district not specifically authorized and permitted are prohibited. SECTION 4. In compliance with the provisions of said Butte County Code, Chapter 24, the same is hereby amended by adding this ordinance in full. SECTION 5. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Butte County Code, Chapter 24, this Ordinance shall from and after its effective date become a supplement to and part of the Butte County Cade, Chapter 24. SECTION 6. This urgency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen X15) days after its passage shall be published once with the names of the members of the Board of Supervisors voting for and against the same in the. Chico enterprise Recara a~~newspaper in general circulation in the County of Butte, State of California. The facts constituting the urgency on which this Ord~unance is I based are: 1.
