The Board of Supervisors of the County of Butte, State
of California, under and pursuant to Chapter 24-30 of .the Butte
County Code, and declaring an emergency, DO ORDAIN as follows:
SECTION 1. The hereinafter described area situated in
the County of Butte, State of California, shall be and it is
hereby zoned as an "A~40" (Agricultural} District for a period
of 120 days, and such area shall be subject to the restrictions
and restricted uses and regulations hereinafter specified and
provided.
Said area so zoned being located in the unincorporated
area of Butte County, Chico, more particularly described as

All of Sections 2fi, 27, 28, 33, 34, and 35, T23td,
R1E, MDB & M excepting therefrom all that portian

Al l of Sections 2 and 3, T22N, Rl E, R9DB & M
excepting therefrom all that portion located within
the city limits of Chico,
That portion of the N 1/2 of Sectian 4, T22N,
RIE, MDB & M Iacated west of the city limits of
Chico.
That portian of the S 1/2 of Sectian ~, T22N, RIE,
N~DB & M located east of Nicks Lane. Excepting
therefrom all that portion located within the
City limits of Chico.
That portion of Sections 9, l0, and II, T22N,
R1E, MDB ~ M located north of Sycamore Creek.
Excepting therefrom that portian located within
the city limits of Chico.

SECTION 2. REGULATIONS FOR AN "A-40" DISTRICT.
The following regulations shall apply in an "A-40"
District .
~A) USES PERMITTED,
1. One single-family dwelling per parcel, including
mobile homes.
2. General agriculture farming, horticulture,
commercial livestock, poultry production, growing
and harvesting forestry products, warehousing
and storage. ~,
3. Accessory buildings and uses pertinent to the
permitted uses, including agricultural processing
pldntS .
4. Housing facilities (including trailers) to accomo-
date only employees and their families employed by
the owner or operator o.f the premises; and pro-
vided further that such housing facility shall be
considered accessory to the main building and
shall conform to the provisions pertaining to
required yard and open space for dwellings.
5. Mining, quarrying, commercial excavation and
wood processing plants.
6. blunting and fishing camps, including those which
accommodate recreational vehicles and travel
tra i 1 ers , provi ded that sai d recreati anal vehicles
and travel trailers shall not be used for year-

round occupancy.
(B} MINIMUM LOT AREA REQUIRED
Minimum lot area shall not be less than forty {40)
acres.
{C) FRONT YARD SETBACK
Minimum front yard setback shall be fifty {50) feet
from the centerline of~the road, except where the
road is classified by the County as a Federal Aid
Secondary Road, the minimum building setback
requirements shall be fifty-five (55) feet from the
centerline of the road,
{D) SIDE AND REAR YARD REQUIRED.
Minimum side and rear yard shall not be less than
twenty-five {25) feet.
SECTION 3. All uses of land within the district not
specifically authorized and .permitted are prohibited.
SECTION 4. Iri compliance with the provisions of said
Butte County Code, Chapter 2G~, the same is hereby amended by
adding this ordinance in full.
SECTION 5. The penalties far the violation of the
zoning hereby imposed within the district shall be as provided in
the Butte County Code, Chapter 24, this Ordinance shall from and
after its effective date become a supplement to and part of the
Butte County Code, Chapter 2Q~.
SECTION 6. This urgency ordinance shall take effect
immediately upon its passage, and before the expiration of fifteen

(15) days after its passage shall be published once with the names
of tt~e members of the Board_of Supervisors voting for and against

the same- i n the Chico Enter rise Record a newspaper i n general
circulation in the County of Butte, State of California. The
facts constituting the urgency on which this Ordinance is based
are:
1. To protect the health, safety, and welfare of
the public.
PASSED AND ADOPTED by the Board of Supervisors of the
County of Butte, State of California, on the 22nd day of
Maxch 1977, by the following vote:
