BUTTE, STATE DF CALIFORNIA, A "TM-40" (TIMBER
MDUNTAIN) DISTRICT, PURSUANT TO CHAPTER 24-29.

The Board of Supervisors of the County of Butte, State of
California, under and pursuant to Chapter 24-29 of the Butte County Code of
said County D0 ORDAIN as follows:
SECTION 1. The hereinafter described area situated in the County
of Butte, State of California, shall be and it is hereby zoned as a "TM-40"
(Timber Mountain) District, and such area shall be subject to the restrictions
and restricted uses and regulations hereinafter specified and provided,
Said area so zoned being located in the unincorporated area of
Butte Gounty, northeast of Chico, more particularly described as follows:
A Portion of Sections 1 and 12 of T22N, R2 E, MDB&M,
Sections 25 and 36 of T23N, RZE, NIDB&M, and Sections
30 and 31 of T23N, R3E, MDB&M more particularly
described as:
Beginning at the NE corner of Sec. i, T22N, R2 E, MDB&M
south to the SE corner of said Sec. 1 also being the
NE corner of Sec. 12, T22N, R2 E, thence westerly along
the north line of said Sec. l2, 1336,51 fto; thence
southerly, parallel with the east line of said Sec. 12,
1347.53 ft.; thence westerly, parallel with the north
line of said Sec, 12, 1294.46 ft.; thence S 68° 58' 08" W,
1718.56 ft.; thence N 29° 26' 43" W, 1731.61 ft.; thence
N 31° 16' 08" E, 668.51 ft.; thence N 27° 54' 23" E,
1199.0& ft.;thence N 05° 47' 20" W, 371.68 ft.; thence
N 30° 34' 28" W, 807 ft.; thence N 34° 40' 17" E, 711.17 .
ft.; thence northerly 2567.29 fto to a point on the
north line of said Seco 1 located 4074064 ft. westerly
of the NE corner of Said Sec. l; thence easterly to the
SW corner of the SE 1/4 of the SW l/4 of Seco 36 T23N,
R2E, MDB&M; thence northerly, parallel with the west
line of said Seco 36 to a point on the east-west
centerline of said $eco 36; thence east to the center
of said Sec, 36; thence northeasterly to the NE corner
of said Seco 36; thence northerly to the NW corner of
Seca 30 T23N, R3E, MDB&M; thence southeasterly to the
center of said Sec. 30; thence southerly to the center
of Sec. 31 T23N, R3E, MDB&M; thence southwesterly to
the NE corner of Sec. 1, T22N, R2 E, MDB&M and the true
point of beginning.

SECTION 2, REGULATIONS FOR A "TM-40" bISTRICT:
The following regulations sha11 apply in a 1TTM-40" bistrict.
(A) USES PERMTTTEb:
to One single-family dwelling per parcel, including mobile
home.
2. Management, raising, harvesting and removal of trees,
shrubs, seedlings, flowers, herbs and all food crops
for ~~ ax animal consumptionQ
3, Keeping and xaising sma11 animals for domestic use,
including dogs, cats and household pets, poultry and
other birds, bees, fish and frogs.
4. Keeping, raising and pasturing of cattle, horses,
sheep, goats, hogs or other livestock, provided
that no more than two {2) such animals be kept per
acre on parcels of less than five (5) acres and na
more than four (~) such animals be kept per acre
on parcels of five {5) acres or more.
5. Prospecting, claiming, drilling, mining, excavating
and dredging of mineral, hydrocarbon and geothermal
resources, excepting as limited in Section (B) below.
6. Protection of land and forests from fire, erosion,
floods, slides, quakes, insects, diseases and

pollution, including arboretums and natural wilderness,
experimental and study areas.
7o Display and sale of prod,uets of agricultural. uses and
home arts and crafts produced on the premises,
8. Accessory uses, improvements and structures customary
and pertinent to permitted uses, except as limited in
Section (B) below, including guest houses, barns, sheds,
shops, garages and storage areas.
(B) USES PERMTTTEA SUBJECT TO FIRST SECURING A USE PERMMiCT

be objectionable by reason of noise, odor, smoke, dust,
bright light, vibration, stream pollution or handling
of explosives or dangerous materialso
7, Commercial beat ramps, docks, and landing facilities.
S. Aircraft landing facilities.
9. Disposal areas and sewage treatment facilities.

1 10, Public and quasi-public uses including schools, parks,
2 playgrounds, recreational facilities, utility system

structures, meeting halls, hospitals, libraries, museums,
4 government offices and similar uses.
5 ll. Private or commercial outdoor recreation facilities on
6 sites of not less than five (5) acres, including country
7 clubs, golf courses, riding academies and stables, hunting
$ and fishing camps and other clubs, and gun clubs and
9 ranges.
30 (G) LOT AREA:
11 Minimum required area of a lot per dwelling unit shall not
12 be less than forty (4Q) acres for "TM-40",
13 (D) LOT WIDTH REQUIRED;
14 Minimum required lot width shall not be less than sixty-
15 five (65) feet. ',
16 (E) FRONT YARD REQUIRED:
~.7 Minimum required front building setback shall be not
18 less than fifty (50) feet from the centerline of the
19 goad, except where the road is classified by the
20 County as a Federal. Aid Secondary Road, the minimum
21 required front building setback shall be not less
22 than fifty-five (55} feet from the centerline of
23 the road.
24 (F) SIDE YARD REQUIRED:
25 Minimum required side building setback shall be not
26 less than twenty-five (25) feat for "fiM-4O",

(G) REAR YARL1 REQiTIRED:
Minimum required rear building setback shall be not

SECTION 3. A11 uses of land within th.e district not specifically
authorized and pernnitted are prohibited.
SECTION 4. In compliance with the provisions of said Butte
County Code, Chapter 24, the same is hereby amended by adding this
Ordinance in full.
SECTION 5. The penalties for the violation of the zoning
hereby imposed within the district shall be as:~pravided in the Butte
County Gode, Chapter 24, this Ordinance shall from and after its
effective date become a supplement to and part of the Butte County
Code, Chapter 24.
SECTION b. This Ordinance shall be and it is hereby declared
to be in full force and effect from and after thirty (30) days after the
date of its passage, and before the expiration of fifteen (15) days after
its passage, this Ordinance shall be published once with the names of the
members of the Board of Supervisors voting for and against it in the
Chico Enterprise Record, a newspaper published in the County of Butte,
State of California.
