Resolution No. 18-144
RESOLUTION AUTHORIZING THE PURCHASE OF 655 OLEANDER AVENUE IN CHICO, CALIFORNIA
FROM THE STATE OF CALIFORNIA,
ACTING BY AND THROUGH THE JUDICIAL COUNCIL OF CALIFORNIA
WHEREAS, pursuant to the Trial Court Facilities Act of 2002(Government Code sections 70301 et seq.),
in 2007, the County of Butte ("County"), transferred the real property commonly known as the old Chico
Courthouse; a portion of Assessor's Parcel Number 003-180-004, located at 655 Oleander Avenue in Chico,
California ("Property") to the State of California, acting by and through the Judicial Council of California
("Council"), and
WHEREAS, the Council constructed a new court facility in Chico known as the North Butte County
Courthousefor use by the Council and into which the prior functions of the Property have been
consolidated, making the Property surplus to the needs of the Council; and
WHEREAS, the Property sits between the County Government Building on Memorial Way and the
County Public Health Facility on Oleander Avenue. In order to retain control of the Property for future
County facility needs, in June 2017, the County and the Council entered into a Lease for Real Property
("Lease")that gave the County the statutory right under Government Code section 70391, subdivision(c)(2)
to repurchase the Property at its current fair market vallue; and
WHEREAS,the Butte County Office of Education ("BCOE") occupies a County owned facility within the
Orovillle Government Campus at 5 County Center Drive in Oroviille, California ("CC5"), that is now required
for County use. Once the conveyance of the Property from the County to the Council is consummated,the
County intends to enter a long term lease with BCOE for the Property in exchange for BCOE vacating CC5;
and
WHEREAS, on August 22, 2017, the Board of Supervisors of the County of Butte ("Board of
Supervisors") approved the Butte County Capital Improvement Program ("CIP"), which is a budgeting plan
for the County's service and transportation infrastructure improvements for the next ten years. Included
in that CIP was the purchase of the Property using a portion of Facility Reserve which is the fund balance in.
the Capital Projects Fund and on July 24, 201.8 the Board approved the re-budget for Fiscal Years 2018-
2019; and
WHEREAS, the specific terms and conditions of the sale of the Property for a purchase price of Eight.
Hundred Thirty Thousand Dollars ($830,000) plus title and escrow fees, is contained in the Purchase and
Sale Agreement ("Agreement") between the Council, as Seller and the County, as Buyer, with an effective
date of September 25, 2018; subject to reasonable extensions, the escrow would close on October 1, 2018.
NOW, THEREFORE, BE IT RESOLVED that the 'Beard, hereby finds that it is in the beet interest of the
citizens of the County to approve the purchase of the Property by execution of the Agreement and
authorize the Butte County Department of General Services — Director, on behalf of the County and the
Board, to execute any and all documents necessary to effect the purchase and the recordation of any
Deeds, including the related Certificates of Acceptance.

the following vote:
