RECORDING OF THE GRANT OF LICENSE(CITY OF CHICO/COUNTY OF BUTTE) ENCROACHMENT
ON PUBLIC RIGHT OF WAY—900 ESPLANADE
WHEREAS,the County of Butte,a political subdivision of the State of California ("County,"),owns the real property
described as Assessor's Parcel Number 003-171-014-000; commonly known as the Veterans Memorial Building, located
at 900 Esplanade in Chico ("Property"); and
WHEREAS,the Museum of Northern California ,Art, a California nonprofit benefit corporation ("monca"), leases a
portion of the Property from the County. Under the terms of that lease, monca was to construct or cause to be
constructed, an exterior accessible ramp that complies with Title 24 of the California Code of Regulations and the
Americans with Disabilities Act Accessibility Guidelines ("Ramp"); and
WHEREAS, several different options for placement of the Ramp were explored and it was determined that the
Ramp should be constructed on the west(Esplanade)side of the Property,at the main entrance to the Veterans Memorial
Building (Building). Since the Building occupies most of the Property footage it is not possible to construct an accessible
Ramp entirely on the Property. The Ramp would also require a building permit from the City of Chico(",City")whish would
require a Grant of License ("License")from the City as the owner of the adjacent property; and
WHEREAS, a formal request was made by the County to the City for the issuance of a License for encroachment
on the City's public right of way and on March 28, 2017, the parties executed an agreement entitled "Grant of License
(City of Chico/County of Butte) Encroachment on Public Right of Way—900 Esplanade" ("Agreement"); and
WHEREAS, in order to memorialize the Agreement, the County intends to deliver the Agreement to the Butte
County Clerk-Recorder for recording. Pursuant to Government Code section 27281,a Certificate of Acceptance is required
when a governmental agency is acquiring real property rights.
NOW,THEREFORE, BE IT RESOLVED that the Board, hereby finds that it is in the best interest of the citizens of the
County to authorize the Butte County Department of General Services—Director, on behalf of the County and the Board,
to execute any and all documents necessary for the recordation of the Agreement, including the related Certificate of
Acceptance.
