NOW,THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby adopts the Butte County Ethics Training Policy for Local Agency Officials, as set forth in Exhibit A, which shall rescind and replace any previously adopted Ethics Training Policy in its entirety, PASSED AND ADOPTED by the Butte County Board of Supervisors this Stn day of October, 2018, by the following vote: AYES: Supervisors Connelly, Wahl, Kirk,Teeter, and Chair Lambert NOES. This policy shall supersede any ethics training policy previously adapted by the Board of Supervisors. PURPOSE This policy identifies the ethics training responsibilities for elected and appointed County officials, members of Butte County boards, committees, and commissions, and employees designated under the County's Conflict of Interest Code to file Statements of Economic Interest - Form 700. Further, this policy identifies the County- approved Ethics Training Course, and details how to complete the Ethics Training Course. Lastly, this policy identifies filing officers and sets forth a document retention policy for Certificates of Completion. AUTHORITY Assembly Bill No. 1.234 (AB 1234) (Chapter 700, Statutes of 2005) requires specific public officials to complete ethics training every two years. These requirements are codified in California Government Code section 53234 through 53235.2. POLICY SCOPE This policy appllies to the following: 1. Members of the Board of Supervisors, pursuant to Government Code section 53232, and elected and appointed officials, pursuant to Government Code section 53234(c)(1), (collectively County Officials); 2. Members of boards, committees, commissions, or other body of a local agency, whether permanent or temporary, decision-making or advisory, created by charter, ordinance, resolution or formal action of the Board of Supervisors (Legislative Body Members), pursuant to Government.Code section 54952(6); and 3. All employees designated by the County's current Conflict of Interest Code to fine Statements of Economic Interest—Form 700 (Form 700 Filing Employees), pursuant to Government Code section 53234(c)(2) County Officials, Legislative Body Members, and Form 700 Filing Employees shall hereinafter be referenced collectively as Local Agency Officials. PROCEDURE 1. Positions Mandated to Complete Ethics Training Course a. Local Agency Officials as defined by Government Code sections 53232 and 53234, et seq. 2. Deadlines for Completing Ethics Training Course a. Local Agency Officials shall complete the Ethics Training Course within their first year of appointment,election,or employment, and every two years thereafter, prior to December 31. 3. How to Complete the Ethics Training_C_ou__rse a. The California Fair Political Practices Commission (FPPC) has established a cost-free, two hour, online Ethics Training Course that satisfies the requirements of Ethics Training. The course can be found at http://Iocalethics,fppc.ca.gov. The FPPC's Ethics Training Course is the County-approved Ethics Training Course. i. Note: Ethics Training Courses are also offered by a variety of organizations, both online and in person.Typically,there is a cost associated with these programs.The County shall not be responsible for reimbursement of any costs associated with Ethics Training Courses. b. A Certificate of Completion for at least two hours of local office Ethics Training from either the County-approved Ethics Training Course, or a course that meets the Attorney General's AB 1234 training guidelines. 4. Where to File Certificates of Completion In order to be in compliance with the Ethics Training requirements, Certificates of Completion shall be filed as follows: a. Form 700 Filing Employees shall file their Certificates of Completion with their respective Department Head. (Reference the current County Conflict of Interest Code) b. County Officials shall file their Certificates of Completion with the Clerk of the Board. c. Legislative Body Members shall file their Certificates of Completion with the Department Head of the department staffing the board, committee, or commission, or the Clerk of the Board. 5. Filing Officers and Responsibilities a. Department Heads 1. Each Department Head, or designee, shall be considered the f=iling Officer for the Certificate of Completion for all Form 700 Filing Employees within their department,and for any Legislative Body Members; and ii. Pursuant to Government Code section 53235(f), each Department Head, or designee, shall be responsible for providing annual written notices of the Ethics Training requirements and available training to all Form 700 Filing Employees within their department and Legislative Body Members; and 2 iii. Each Department Head, or designee, shall be responsible for ensuring that all Form 700 Filing Employees within their department,and any Legislative Body Member comply with the Ethics Training requirements within one year from the date of hire or appointment, and once every two years thereafter, prior to December 31. b. Clerk of the Board i. The Clerk of the Board, or designee, shall be considered the Filing Officer for the Certificate of Completion for all County Officials, and any Legislative Body Member; and ii. Pursuant to Government Code section 53235(f),the Clerk of the Board,or designee,shall be responsible for providing annual written notices of the Ethics Training requirements and available training to all County Officials, and any Legislative Body Member; and iii. The Clerk of the Board, or designee, shall be responsible for ensuring that all County Officials,and any Legislative Body Member,comply with the Ethics Training requirements within their first year of election or appointment, and once every two years thereafter, prior to December 31. 6. Retention Schedule for Certificates of Completion Pursuant to Government Code section 53235.2, Filing Officers shall maintain the records indicating: 1)the dates that the Ethics Training Course was completed; 2) the entity that provided the training; and 3) the Certificates of Completion,and retain these records for a period of five years from the date of completion. 3
