Resolution No. 18-173
RESOLUTION OF THE COUNTY OF BUTTE, BOARDOF SUPERVISORS
DELEGATING AUTHORITY TO THE COUNTY ADMINISTRATIVE OFFICER TO DEVELOP AND IMPLEMENT
PROCESSES TO TRANSACT PERSONNEL RELATED IMPACTS FROM THE CAMP FIRE EMERGENCY INCIDENT
WHEREAS, on the morning of November 8,2018,the catastrophic Camp Fire impacted Butte County necessitated
evacuation orders and warnings for all persons in the affected areas; and
WHEREAS, the issuance of the immediate widespread evacuation order and evacuation warnings resulted in the
establishment of an emergency operation center, and the closure of various highways and public facilities in and around
the Paradise, Cherokee, Berry Creek, Concow, and Magaha Areas;, and
WHEREAS, hundreds of County employees and residents were adversely impacted by the Camp Fire, Many
employees lost personal property, possessions, and/or were evacuated from their homes for several days. As a result,
many employees were unable to work their normal assigned shifts, and
WHEREAS, the Camp Fire incident has created complex administrative and personnel) issues that are currently
being identified, assessed and discussed, and will require expeditious resolution over the coming weeks in order to
maintain the efficient operation of county government; and
WHEREAS, the Camp Fire incident, which is out of the control of the County and its employees, has created an
unique and dynamic situation; and
WHEREAS,the County places the safety of constituents and employees as its main priority; and
WHEREAS,while the County (1) is not legally required to pay non-exempt employees for shifts missed due to the
disaster (2) is permitted to require exempt employees to utilize vacation or administrative leave for shifts that were
missed, it is in the best interests of the County that employees who were prohibited from serving during the Camp Fire
Incident should not be financially burdened.
NOW,THEREFORE, BE IT RESOLVED:
1. The Butte Couinty Board of Supervisors delegates authority to the Chief Administrative Officer, in consultation with the
Director of Human Resources, to develop, implement and report back to the Board of Supervisors on the processes and
payroll rules developed to compensate employees who were unable to work on Monday November 12, 2018 through
December 3, 2018 due to the e'vacuati'on order, including granting paid time off for the period of November 12, 2018
through November 30, 2018.
2. The Board of Supervisors finds that there are several pwbUic purposes supporting this compensation, including the
resolution of uncertainty surrounding this issue, nammUution of potential inconsistency in the treatment of employee
compensation,the continued recruitment and retention of competent and skilled government employees and maintaining
the County Vf Butte's position in the competitive labor market, efficiency and the avoidance of potential labor disputes.
3.This remoUutio�nshall not beprecedent setting.
