That Chapter 9 of the Butte County Code is Thereby amended to read as follows: §9-1. "Public dance" defined. §9-2 "Skating rink" defined. E §9-3. License---Required §9-4. Same--Application §9-5. Same--Approval or re~;ection by board; revocability §9-6. Same--Temporary license. §9-7. Same--Fees; exemptions. §9-$. Same--To be displayed on premises. §9-9. Serving or drinking intoxicating liquor; F persons under influence of liquor. §9-10. Vulgar dancing. E §9-ll. Conduct of public dances, etc.; forfeiture of~ ' license far misconduct. i §9--12. Employment of security. Section '9-l. "Public dance" defined. A public dance for the purpose of this chapter is ~' hereby defined to be any dance in unincorporated territory of the county at which a fee, charge, or compensation for admission is exacted. 'S'ection 9-2. "Skating rink" defined. E A skating rink for the purposes of this chapter is ;hereby defined to be any enclosure used for the purpose of roller or ice skating, in unincorporated territory of the county, at which a fee, charge or compensation for admission is exacted. Section 9-3. License--Required. Tt is unlawful in the unincorporated territory of the i. i; 1 ;county to open, carry on or conduct a public, dance, public dance 2~ha11 or skating rink without first obtaining a license therefor :~ 3 `; as provided by this chapter. 4` Section 9-4. Same--Application. 5:` A person desiring to hold a public dance or to open, is 6'carry on or conduct a public dance hall or any hall, room, ? pavillion or place in which a public dance i~s to be held or a' 8`,skating rink shall make application for a license or permit to 9!°'do so by filing such application with the Treasurer of the l0 county, which application. shall describe the hall, room, pavillion 11 ``place or rink wherein it is desired to conduct a public dance 12 hall or skating rink and his application shall be accompanied 13 Eby the fees prescribed by section 9~7. E 1 14 ~: Section 9-5. Same---Approval or rejection by Sheriff; 15 ,revocability. I6 The sheriff is hereby granted the right to approve or 27 `reject any such application anal in granting the same each permit is 18'sha11 contain the provision that it shall be revocable at will lg'`by the board. The sheriff shall approve such license unless he 2~`determines that the granting of such license would be dEtrimental 21'~to the public health or safety. Any disapproval may be appealed 22 by the applicant to the board of supervisors. The clerk of the ~~ ;board of supervisors shall advise the applicant and the sheriff 24. of the place and time that the board of supervisors shall hear ~ the appeal. 26` 2. l Section 9-6. Same--Temporary license. 2 If an application to conduct a dance, dance ha11 or more 3 than one dance or skating rink is made, it is the duty of the, 4 treasurer to deliver the application to the sheriff of the county, 5~ who, in his discretion, may issue a temporary license or permit. 8 Section 9-7. Sarne--Fees; exemptions. 7' License fees to conduct a skating rink, public dance, 8` dance hall ar series of dances are payable in advance and are 9€ hereby fixed as follows: The sum of fifteen dollars ($15.04) 10, quarterly ar five dollars ($5.44) monthly or two dollars and 1.1 fifty cents ($2.50) for a single dance. 12 In the event a monthly license is issued far two successive 13 months for any given lacatian, licensee shall thereafter be 14' required to obtain a license on a quarterly basis. 15 The sheriff may, in his discretion, grant a license without 16. charge for any single dance, if such dance is held for eleemosynary 17 purposes. 18 All licenses to conduct a skating rink, dance hall. or 7,9 more than one dance, shall be valid so long as the quarterly fee 20 therefor is paid in advance and in no event shall continue in farce 21 ar be effective after the thirty-first day of December following 22'-its issuance. ~~ Section 9-$. Section 9-9, Serving or drinking intoxicating"liquor; ,persons under influence of liquor. Zt is unlawful for any person to serve or drink any intoxicating liquor in or about any public dance or skating rink or in or about any premises where a public dance or skating rink is being conducted in unincorporated territory of the county without first obtaining a permit from the ASC board and approved by the sheriff. Zt is unlawful for any person to enter or remain in or about any premises where a public dance or skating rink is being ;conducted within unincorporated territory of the county while :under the influence of liquor, Section 9W10. Vulgar dancing. It is unlawful for any person to conduct or to engage in 'any form of dance that is suggestive of vulgarity at, in or about any premises at which a public dance is being conducted, Section 9--11. Conduct of public dances, etc.; forfeiture ~of license for misconduct. Zt is the duty of one conducting a public dance or .public dance hall or skating rink to preserve order therein at -all times and to e,~ect from the premises where such public dance or skating rink is being. held, any person violating any of the provisions of this chapter and in the event such person shall permit to be carried on therein any of the acts or things by this article prohibited or to permit disorder in or about such dance 4. i 2 3 4 6' 6 8 9 a.o lI` 12 13 14 1~' 18: 1'~ 1$ 19 20 2].' 22 23' 24 23 28' shall or such dance or skating rink, such person shall automaticall `forfeit his license and shall be prohibited for a period of one E Eyear after such violation and forfeiture from making application ', to conduct a public dance hall, dance or skating rink. Section 9--12. Employment of security. Any person who conducts a public dance or skating rink `shall employ at his own expense a security approved by the sheriff ~of the county to supervise the conduct of aTl persons in atten- dance at such dance or skating rink, whether inside or outside of the structure used for dancing or skating. Section 2.
