B 7 H 9 10 11 Z2 i3 ~~ 14 ~.5 16 1'7 18 is as 21 22 23 24 2S 26 The Board of Supervisors of the County of Butte, State of California, under and pursuant to Chapter 24-30 of the Butte County Code, and declaring an emergency, DO ORDAIN as follows: SECTION I. The hereinafter described area situated in the County of Butte, State of California, shall be and it is i hereby zoned as an "R-4O" (Agricultural} District fora period of I~' one year and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Containing 1271.G3 acres, 26 mare or less, Chico. -2- 1 SECTION 2. REGULATIONS FOR AN "A-4O" DISTRICT. 2 The following regulations shall apply in an "A-40" 3 District: 4 {A) USES PERC~IITTED 5 7. One single-family dwelling per parcel, including 6 mold l e homes . 7 2. General agri cul turd farming, horticulture, 8 commercial livestock, poultry production, 9 growing and harvesting forestry products, 10 warehousing and sto-rage. 11 3. Accessory buildings and uses pertinent to the 12 permitted uses, including agricultural pro~- 13 cessing plants. Z4 ~. Housing facilities {including trailers) to 15 accommodate only employees and their families 16 ~ employed by the owner or operator of the premise Z7 and provided further that such housing facility 18 shall be considered accessory to the main 19 building and shall conform to the provisions 20 pertaining to required yard and open space for 2I dwellings. 22 5, Mining, quarrying, commercial excavation and 23 wood processing plants. 24 6. Hunting and fishing camps, including those 2g which accommodate recreational vehicles, and 2s travel trailers, providing that said -3- ;; Z recreational vehicles and travel trailers shall 2 not be used for ,year-round occupancy. 3 (B} MINIMUM LOT AREA REQUIRED 4 Minimum lot area shall not be less than forty (40} 5 acres. 6 (C) FRONT YARD SETBACK 7 Minimum front yard setback shall be fifty (50) 8 feet from the centerline of the road, except where 9 the road is classified by the County as a Federal ZO Aid Secondary Road, the minimum building setback 1Z requirements shall be fifty--five (55) feet from 1.2 the centerline of the road. 13 ~(D} SIDE AND REAR YARD REQUIRED ].4 Minimum side and rear yard shall not be less than 15 twenty-five (25) feet. 16 SECTION 3. All uses of land within the district not 17 specifically authorized and permitted are prohibited. 18 SECTION 4, In compliance with. the provisions of said 19 Butte County Code, Chapter 24, the same is hereby amended by 20 adding this ordinance in full, 21 SECTION 5, The penalties for the vidlation of the 22 zoning hereby imposed within the district shall be as provided in 2~ the Butte County Code, Chapter 24, this Ordinance shall from and 24 after its effective date become a supplement to and part of the 25 Butte County Code, Chapter 24. 26 - _ .. _~._ 2 3 4 5 6 7 8 9 10 xx I2 ~~ ~4 i5 L6 z~ ].8 19 20 2~. 22 23 24 2S 26 SECTION 6. This urgency ordinance shall take effect .immediately upon its passage, and before the expiration of fifteen (15} days after its passage shall be published once ~~rith the names of the members of the Board of Supervisors voting for and against the same in the Chico Enterprise Record, a newspaper in general circulation in the County of Butte, State of California. The fact constituting the urgency on which this Ordinance is based is: 1. To protect the health, safety, and welfare of the public.
