HomeMy WebLinkAbout1850ORDINANCE N0. i:85o AN ORDINANCE ZONING A PORTION OF THE COtlNTY OF BUTTE, STATE OF CALIFORNIA, AN "R-3" (MEDIUM DENSITY RESIDENTIAL) DISTRICT, PUl~SUANT TO CHAPTER 24-29. 1 2 3 4 5 6 7 8 9 10 11 12 13 Z4 15 16 17 18 19 20 21 22 23 24 23 26 The Board of Supervisors of the County of Butte, State of California, under and pursuant to Chapter 24-29 of the Butte County Code of said County DO ORDAIN as follows: SECTION 1. The hereinafter described area situated in the County of Butte, State of California, shall be and it is hereby zoned as an "R-3" (Medium Density Residential} District, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte County, Chico, more particularly described as follows: Commencing at the most easterly corner of Lot 12 of the Cussick Tract, as shown on that certai n Map filed i n Boob ~ ~"ofw~.~aps ~at~ai?ag~'~8, Butte County Official Records; thence from said point of commencement, northwesterly along the east line of Lot 12 of said Cussick Tract a distance of 254 feet to the true point of beginning for the parcel herein described, said point of beginning being 250 feet northerly of the centerline of East Avenue; thence from said true point of beginning and continuing northwesterly along the easterly line of said Lot 12 to the northeast corner thereof, thence northeasterly along the easterly prolongation of the northerly line of said Lot 12, to a point in the westerly line of that certain parcel of land described as parcel 1 in the deed from Harmon V. Bay and Mae L. Bay to Maude Christie Bay, recorded in Book 48 Official Records at Page 44; thence southeasterly along the westerly line of said parcel 1, to a point that lies distant 250 feet northerly of the centerline of East Avenue; thence southwesterly and parallel to said East Avenue to the point of beginning. and also; Commencing at the mast easterly corner of Lot 12 of the Cussick Tract, as shown on that certain /~ I~ -1 - 1 Maki ~~i i'~~~.i=n 'F Bobk..l. of Baps at Page 48, Butte County ~ff;#cial Records; thence from said pa#nt of 2 commencement, southeasterly along the easterly line of l of 17' of sal d Cussi ck Tract a distance 3 of 246 feet to the true point of beginning far the parcel herein described, laid point being 4 250 feet southerly of the centerline of East Avenue; thence northeasterly and parallel with ~ said East Avenue to a point 453 feet westerly of the easterly line of that certain parcel No. 3 6 described in deed to W. L. Stile Ranches, Inc., recorded in-book 1508 at Page 108 Butte County 7 Official Records; thence southeasterly and parallel with the easterly line of the above 8 mentioned Stile parcel a distance of 392 feet; thence northeasterly and parallel with East 9 Avenue 453 feet to the easterly Sine of said Stile parce3; thence southeasterly along the l0 East line of said Stile parcel to the north line of Reed Park Subdivision Unit No. 2; thence 1]. southwesterly along the north line of said Reed Park Subdivision and the southerly line of~the 12 aforementioned Parcel No. 3 in deed to Stiles Ranch Inc., to the southwest corner thereof; 13 thence northerly along the west line of sand Parcel Igo. 3 to the true point of beginning. 14 Containing 55 acres, mare or less. 15 16 SECTION 2. REGULATIONS P'OR AN "R-3" DISTRICT: 17 The fallowing regulations shall apply in an "R-3" 18 District. 19 (R) USES PERMITTED: 20 1. One-family dwellings, two family dwellings and 21 multiple family dwellings, not inGludit~g tents, 22 trailers, or mobile- homes. 23 2. Accessory buildings pertinent to the permitted use 24 3, Wausehold pets (but not including livestock, 25 ~ poultry or poisonous reptiles.} 2B ...,. -2- -. 1 (B) THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT 2 IN EACH CASE: 3 1. Golf courses and country clubs. 4 2. Public and quasi-public uses including churches, 5 firehouses, hospitals, parks and playgrounds, B schools and public utility buildings. 7 3. Sales trait office. 8 (C) 7HE PROVISIONS OF SECTION 24-33 SHALL APPLY. 9 SECTION 3. All uses of land within the district not l0 specifically authorized and permitted are prohibited. ZI SECTION 4. In compliance with the provisions of said 12 Butte County Code, Chapter 24, the same is hereby amended by adding ~~ this Ordinance in full. 14 SECTION 5. The penalties for the violation of the ~5 zoning hereby imposed within the district shall be as provided in 16 the Butte .County Code, Chapter 24, this Ordinance shall from and 17 after its effective date become a supplement to and part of the 18 Butte County Code, Chapter 24. 19 SECTION 6.
