The Board of Supervisors of the County of Butte, State of
California, DO ORDAIN, as follows:
Section 1. That Article 14 of Chapter 2 of the Butte
County Code is hereby added to read as follows:
§2-110. It is hereby established a Community Developmen
Account. This Account shall contain Federal Revenue Sharin; Funds
as appropriated by the Board of Supervisors.
§2-111. The Community Development Account may be
utilized to further the construction of certain public improvement
including sewers, drains, sewage collection and treatment works
and other disposal systems, storm sewer drains and storm water
collection and disposal systems, and other drainage facilities.
.Said Account may also be utilized as a portion of local match to
Federal or State grants for the aforementioned purposes. Said
Account-may also be utilized to fund on-going County departments
and programs.
§2-112. Upon the decision by the Board of Supervisors
to construct any facilities pursuant to the provisions of this
Article, a special sub-account shall be established by tl~e County
Auditor which will clearly delineate all of the casts .for the
specific construction project. Funds from private developers
held on deposit pending the construction of the specific
construction projects may be utilized to partially defray the
costs of the specific project. At the earliest possib.~e time
after the total costs of the specific project are determined, the
benefit to the properties benefited by this specific project shall

be determined by the Board of Supervisors. The amount so designated
for each benefited property shall be established by resolution
covering all properties benefited and said resolution shall be
set for hearing for confirmation. by the Board of Supervisors after
publication pursuant to Government Code §6061 and by posting four
copies of the resolution within the total area benefited. The
determination by the Board of Supervisors after said public hear
Ishall be final.
§2-113. As an additional cost for development permits
established by this Board of Supervisors either by resolution or
by ordinance in the Butte County Code, the proponents of the
requested development permit, including, but not limited to, use
permits, building permits, subdivisions and variances, shall be
required to pay, at the time such permit is granted, the amount
'to which that property is determined to be benefited pursuant to
the provisions of this Article.
§2=114. slotwithstanding anything to the contrary in
this Article, where the specific project involves the construction
maintenance or enlargement of sewer collection treatment and
disposal facilities, the Board shall establish by resolution a
sewer collection fee. The fee must be paid prior to connection
to the sewage facilities affected.
§2-115. All fees collected pursuant to the provisions
of this Article shall. be placed in the Community Development
Account, unless the Board of Supervisors specifically deems to
the contrary.

Section 2. This ordinance shall be and it is hereby
declared to be in full force and effect from and after thirty
{30) days after the date of its passage, and before the expiration
of fifteen (15) days after its passage, this ordinance shall be
published once with the names of the members of the Board of
Supervisors voting for and against it in the Gridley Herald
a newspaper published in the County of Butte,
