bRDINANCE ND. 1853 1 2 3 4 5 6 7 8 9 xa I1 12 13 ].4 15 16 ~7 18 19 20 2~. 22 23 24 25 26 AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY DF BUTTE, STATE DF CALIFORNIA, A "C-2" (GENERAL COMMERCIAL} DISTRICT .s The Board of Supervisors of the County of $utte, State ~ of California, under and pursuant to Chapter 24-30 of the Butte County Code, and declaring an emergency, DO ORDAIN as follows: SECTION 1. The hereinafter described area situated in the County of Butte, State of California, shall be and it is hereby zoned as a "C-2" (General Commercial) District far a period ofOcto~er 4, X977, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located northwest of Chico, more particularly described as follows: All that property located west of and within 300 ft. of Esplanade and between Mud Creek and Eaton Road extension. Excepting therefrom all that portion located within 252.11 ft, of the centerline of Eaton Road extension. All that property located west of and within 300 ft, of Esplanade and between Shasta Ave. and East Ave. Excepting therefrom all that portion located within 660 ft, of the centerline of East Ave. and further excepting theref~ram Lots 1 and 2 of that parcel map recorded in Map sook 57` on Page 58 of the Butte County. Dwellings and dwelling.groups, subject to.the building site area, lot width anal yard requirements specified for residential districts... 1 2. All uses permitted in "C-1" (Light Commercial) 2 D15trictS. 3 3. General commercial uses including art Shops, 4 aviaries, h.ar and cocktail lounges, billiard parlors 5 and pool halls, bowling alleys, building material 6 (retail}, cleaning and pressing establishments, dance 7 halls, interior decorating shops, employment agencies, 8 governmental legislative buildings, gymnasiums, public, 9 commercial or physical cultural studios, hospitals, 1D hotels and motels, laboratories and x-ray facilities, I.~. massage parlors and reducing salons, equipment rentals, I2 pet shops, used ear lots, repair garages, auto car 13 washes, plumbing shops, cabinet shops, sign=.manufacturing Z4 shops, and other retail establishments when interpreted 15 as similar. ~.s 4, Accessory uses and buildings pertinent to a 17 permitted use. 18 (B) THE FOl.L(}WING USES SUBJECT TO SECURING A USE PERMIT 19 I~ EACH CASE: 20 1. Welding shops. 2Z 2. Manufacturing of clothing, handicraft praduct~, 22 printing, lithographing and other light manufacturing or 23 industrial uses of similar character. 24 3. Public or quasi-public uses in~l:uding churches.. 25 4. Service stations, drive-in restaurants, kennels, 26 and small animal hospitals and mortuaries. -2- ~ (C) THE REQ~}IREMENTS OF SECTI0IV 24-23 ©F I:HiS CODE ARE 2 MODIFIED FOR ALL BUILDING SITES IN C-2 ZONES IN THE ~ FOLLOWING PARTICULARS: 4 l . Lot width required: Minimum "dot ~wi dth shat l 5 not be less than twenty-five (25) feet. 6 The lat width requirements for residential 7 dwellings shall conform to the requirements for any $ residential zone. 9 2. Side yard requirements: None, except where 10 the side of a lot abuts upon the side of a lot in an ~-~ "R" District, in which case the abutting side yard shall 12 not be less than~~~ve (5) feet; and except where the ~~ side yard an the street side of a corner ]ot abuts on Z4 an "R" District, in which case the side yard on the ~-~ street side sha]7 be one-half the .front yard required ~~ in such "R" Districts. ~7 The side yard requirements far residential ~$ dwellings shal 1 conform to the requirements far any z9 residential xane. 20 3. Rear yard required: Twelve (12) feet, or 2Z five (5) feet adjacent to an alley. 22 SECTI01~ 3. Al 1 uses of l and wi thi n the district not 23 specifically autharized and permitted are prohibited. 24 SECTION 4. In compliance with the provisions of said ~~ Bu~~~ County Code, Chapter 24, the same is hereby amended by 28 adding this Ordinance in full. - 3- 1 SECTION 5. The penalties for the violation of the 2 zoning hereby imposed within the district shall be as provided S in the Butte County Code, Chapter 24, this Ordinance shall~fram 4 and after its effective date become a supplement to and part of 5 the Butte County Code, Chapter 24. s ~ SECTION 5. This urgency ordinance shall take effect 7 immediately upon its passage, and before the expiration of fifteen 8 (15) days after its passage shall be published once with the 9 names of the members of the Board of Supervisors voting for and 10 against the same in the Chico Enterprise Record, a newspaper in 11 general circulation in the County of Butte, State of California. z2 The facts constituting the urgency on which this Ordinance is 13 based are: Z4 1. Ta protect the health, welfare, and safety of the t5 public. 16 2.
