HomeMy WebLinkAbout1858ORDINANCE NO. 1858 AN ~r~TE~2IM ORDINANCE zONING A PORTION OF THE COUNTY OF BUTTE, STRTE OF CALIFORNIA, AN "A-5" (AGRICULTURAL} DISTRICT ~. The Board of Supervisors of the County of Butte, 2 State of California, under and pursuant to Chapter 24-30 of 3 the Butte County Code, and declaring an emergency, DO ORDAIN 4 as follows: 5 SECTION l?. The hereinafter described area situated 5 in the County of Butte, State of California, shall be and it 7 is hereby zoned as an "A-5" (Agricultural} District for a 8 period of 120 days, and such area shall be subject to the 9 restrict~dns and restricted uses and regulations hereinafter ~.0 specified and provided. Z1 'Said area sa zoned being located north of Chico, ~.2 more particularly described as follows: 13 Parcel 1: 1.4 That portion of Section 25, T23N, Rl U, MDB ~:& M located south of Meridian Road, East of State 15 Highway 99, and north of Rock Creek. 16 That portion of the westerly 1309.58 ft. of Sec. 30, T23N, R1E, MDB & M located north of 17 Rock Creek, excepting therefrom the northerly 882.83 ft. of said Sec. 30. . 18 Parcel 2: 19 That portion of the WZ of Sec. 14, T23N, R1Wy 20 located east of State Highway 99. 21 Containing 126.53 acres, more or less, north of Chico. 22 23 SECTION 2.' REGULATIONS FOR AN "A-5" DISTRICT: 24 (A) USES PERMITTED: 23 1. One single-family dwelling per parcel. 26 - - - ..1 - 1 2. General farming, horticulture, commercial 2 livestock, poultry production, warehousing and storage. 3 3. Accessory buildings and uses pertinent to 4 the permitted uses, including agricultural processing 5 plants . 6 4. Housing facilities {including mobile homes} 7 to accommodate only agricultural employees and their 8 families employed by the owner or operator of the 9 premises; and provided further that such housing ld facility sha11 be considered accessory to the main 11 building and shall conform to the provision pertaining 12 to required yard and open space for dwellings. 13 5. Mobile Homes to house one family when such 14 Mobile Home is the only housing facility located on 15 the premises, provided the following conditions are 16 conformed to: z7 a) The floor area within the Mobile Home 18 shall not be less than five hundred (S00} 19 square feet. 2d b} The parcel of land conforms to Section 21 24-72{C) (minimum lot area of 5 acres), or is a 22 smaller parcel of land lawfully created. 23 (B} The following uses are permitted subject to 24 securing a use permit in each case; 25 1. Public or quasi-public uses including churches, fire houses, hospitals, and clinics, parks and play- grounds, schools, public utility buildings. (C) The requirements of Section 24-33 of this Cade notwithstanding, the minimum lot area in A-5 zones shall not be less than 5 acres. SECTION 3. All uses of land within the district not specifically authorized and permitted are prohibited. SECTION 4. In compliance with the provisions of said Butte County Cade, Chapter 24, the same is hereby amended by adding this ordinance in full. SECTION 5. The penalties for the vialatian of the zoning hereby imposed within the district shall be as provided in the Butte County Code, Chapter 24, this Ordinance shall from and after its effective date became a supplement to and part of the Butte County Cade, Chapter 24. SECTION 6. This urgency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen (15) days after its passage shall be published once with the names of the members of the Board of Supervisors voting for and agai:nst the same in the Chico Enterprise-3tecord, a newspaper in general circulation in the County of Butte, State of California. The facts constituting the urgency on which this Ordinance is based are: 1.
