HomeMy WebLinkAbout1862ORDINANCE N0. 1862 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A "PA -C" (PLANNED AREA - CLUSTER) DISTRICT, PURSUANT TO CHAPTER 2b-29. 1 The Board of Supervisors of the County of Butte, State 2 of California, under and pursuant to Chapter 24-29 of the Butte 3 County Code of said County DO ORDAIN as follows: 4 SECTION 1. The hereinafter described area situated in 5 the County of Butte, State of California, shall be and it is 6 hereby zoned as a "PA-C" (Planned Area -Cluster) District, and 7 such area sha11 be subject to the restrictions and restricted uses 8 and regulations hereinafter specified and provided. 9 Said area so zoned being located in the unincorporated 10 area. of Butte County, Forest Ranch, more particularly described 1]. as follows 12 Commencing at the NW corner of Sec. 8, T23N, R3E, MDB&M; thence southerly along the west 13 section line of said Sec. 8, 6b1.2~ ft. to . the true point of beginning; thence N 88° 14 50' 32" E, 1299.89 ft .; thence S 1° 25' 18T, W, 3312.13 ft . ; thence S 89° 09' ~~" ~', 15 1325.66 ft. to the west line of said Sec. 8; thence N ~,° 52' 23" E along said west line 16 3306.00 ft. to the true point of beginning. 17 Containing 100 acres, more or less. 18 SECTION 2. REGULATIONS FOR A "PA-C" DISTRICT: 19 The following regulations shall apply in a "PA-C" 20 District. 27- (A ) PURPOSE 22 The "PA-C" zone is intended to facilitate the 23 development of centers of .residential or light commer- 24 cial activities or a combination thereof and related 2g uses without regard to the traditional limitat~:ons on 26 lot size, road frontage, setback, side yards and rear yar -1- I5 . I 2 3 4 5 s 7 S 9 ~.o I1 i 12 ''i 1.3 l4 15' L6 17 18' 19' 20 2l' 22 23 24 25 26 Said zone is to be applied only to areas determined to be suitable for such uses, as evidenced by a develop- ment plan to be submitted by the applicant to the Planning Commission, and to be evaluated by reference to existing and proposed land uses, the County General Plan and any applicable precise plans. The final development plan, as approved by the Board of Supervisors shall be binding on the developer or subsequent owners ~' as regulations for land uses within the zone. Deviations from the said plan {except minor deviations which da not increase the density or intensity of any use, change the character of any use or introduce any new uses) shall require re-zoning in accordance with an amended development plan. Further, said zone should be applied only where its peripheral boundaries can be adequately integrated with the surrounding public road system and surrounding zones without creating nuisances from noise, fumes, congestion or other causes. (B) USES PERMITTED: 1. Those uses which are permitted in the f'C-1" (Light Commercial.) District without the necessity of securing a use permit. ~. Service Stations. (C) USES PROHIBITED: All other uses of land not specifically authorized -2- 1 under Section 2~-12b(A} above are prohibited. 2 (D} LOT REGULATIONS. 3 There shall be no setback, side yard, rear yard, 4 or lot width or frontage requirements in the areas 5 zoned "~'A-C" . Provided, however, that where a "PA-G" 6 zone abuts a single or multiple family residential zone, 7 the setback requirements of the abutting residential. 8 zone in existence at the time the "PA-C" zone application 9 is acted upon by the Planning Commission shall apply to 10 that portion of the cluster zone along the boundary 11 common to the cluster and residential zone. Desirable minimum. width of any such easement is twenty {20) feet. (F) LOT COVERAGE. No lot {when considered together with its propor- tionate share of any common space) shall be permitted building coverage greater than that permitted in the "C-~." z-one for an equal size lot used for the same purpose. {G) SUPERSESSION. In the event the regulations for this zone clearly conflict with the terms of any other applicable ordinances of the County of Butte except Building, Electrical, Plumbing, and Sewage codes, the provisions hereof shah, control. The provisions of this ordinance shall be construed to be in harmony with all such ordinances unless clearly in conflict therewith. Any subdivision established in a Cluster Zone after the effective date of this ord~.nance shall be deemed to be an "open space subdivision" for the purposes of Section 20--30 .2 of the Butte County Code . {H) IMPROVEMENTS. All improvements within said zone shah, meet the requirements of Chapters l9, 26, 27 and 28 of the Butte County Code. (I ) ~~INTMUM AREA . The minimum area of any "PA--C" district shall be -!} 1 three (3} acres. 2 ( J' ) OFD' STREET PARKING . 3 Off-street parking shall be required pursuant to 4 the following formula. 5 a. Residential Uses: Two (2) parking spaces far g each living unit. 7 b. Offices: One (l) parking space for each 400 g square feet of gross floor area. g c. Retail stores: One {1) parking space far each l,p 300 square feet of gross floor area. yz Said parking area may be owned individually by the 12 owners of more than one lot in common. 13 (K) PROCEDURAL 14 Any application far rezoning to Planned Area-Cluster Z5 shall be accompanied by a preliminary development plan Z6 to be submitted to the subdivision committee for review 17 and report pursuant to Section 20-13 of the Butte County ].S Code, As to farm and content, the preliminary develop- Zg ment plan map and the review process shall conform to 20 the requirements of said Code for a tentative subdivision 2~. map. Upon receipt of the recommendations of the 22 Committee, the Planning Director shall set the application 23 for hearings as in the case of other rezoning application 24 SECTION 3• All uses of land within the district not 25 specifically authorized and permitted are prohibited. 26 SECTION 4. SECTION 5. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Butte County Code, Chapter 24, this Ordinance sha11 from. and after its effective date become a supplement to and part of the Butte County Code, Chapter 2~. SECTION b. This Ordinance sha11 be and it is hereby declared to be in full force and effect from and after thirty {30) days after the date of its passage, and before the expiration of fifteen {1~) days after its passage, this Ordinance shah. be published once with the names of the members of the Board of Supervisors voting for and against it in the Chico Enter rise a newspaper published in the County of Butte, State of California.
