BUTTE, STATE OF CALIFORNIA, AN "R-C" (RESOURCE
CONSERVATION) DISTRICT, PURSUANT TO CHAPTER 2~-2g.

The Board of Supervisors of the County of Butte, State
of California, under and pursuant to Chapter 24-29 of the Butte
County Code of said County DO ORDAIN "as follows:
SECTION 1. The hereinafter described area situated in
the County of Butte, State of California, shall be and it is
hereby zoned as an "R-C" (Resource Conservation) District, and
such area shah be subject to the restrictions and restricted uses
and regulations hereinafter specified and provided.
Said area so zoned being located in the unincorporated
area of Butte County, Magalia, more particularly described as

Beginning at the S 1/4 corner of Sec. 23,
T23N, R3E, MDB'&M; thence S $9° 33' ~#]." W,
903,66 ft. along the south line of said
Sec. 23; thence northeasterly to a point
located S 89° 52' ~}4" W, 250 ft. distant
" from the NE corner° af" the SE 1/4 of the
SW 1/~# of said See. 23; thence N $9° 52'
~4" E, 250 ft.; thence S 0° 0' ~9" W,
1279.11 ft, to the true point of beginning.
Containing 16.9 acres, more or less.
SECTION 2. REGULATIONS FOR AN "R-C" DISTRICT:
The following regulations sha11 agply in an "R-C"
District.
(A) USES PERMITTED:
1. Natural, wilderness and study areas.
2. Preserves far native fish, birds and wildlife.
3. Preservation of water resource areas, including
streams, rivers, lakes, swamps, ponds, beaches,
riverbanks, lakeshores and watershed areas.

4. Agricultural. uses, not including permanent
dwellings .,
5. Keeping, raising and pasturing of livestock, not
including feed yards.
6. Establishment of archeological and historical
sites.
7. Recreational uses not requiring permanent improve-
ments, including hunting, fishing, camping,
hiking, riding and similar uses.
8. Emergency uses needed for the protection of land
and resources from fire, erosion, floods, slides,
quakes, insects, diseases, and pollution.
(B} USES REQUIRING A USE PERMIT:
1. Preserves for non--native wildlife species.
2. Establishment of rest stops, vista points, and
bicycle, pedestrian and equestrian trails, not
including commercial sales and services.
~. Exploration and reconstruction of historical and
archeological sites and structures.
~. Permanent improvements needed for 'the protection
of land and resources from fire, erosion, floods,
slides, quakes; insects; diseases and pollution,
~, Stations to monitor air quality, water quality
and seismic activities.
6. Mining and quarrying.. This permit does not
exclude any other permits as required b y other

regulatory agencies or from review by said ':
agencies.
(C) LOT AREA REQUIRED:
Minimum lot area shall be ten (10) acres.
{D) FRONT BUILDING SETBACK:
Minimum front building setback for structures shah.
be one hundred (1D0) feet from the centerline of
the road.
{E) SIGN REGULATIONS:
1. Signs or advertising d~.splays shall be limited to
one sign per lot advertising the sale or .ease of
that lot ar the services rendered on the lot or
the products grown or raised on the lat, and ane
sign advertising sales ar services off the
premises.
2. Signs to guide. traffic to registered historical
landmarks are also permitted if they are installer
in accordance with the Planning Manual of
Instructions of the Department of Transportation
of the State of California.
3. Signs-must be stationary and of a constant color,
light, and intensity.
~. Signs must not be higher than ten (Ip) feet above
grads and must not be wider than six (6) feet.
5. All signs must be located behind the front
setback line.

(F) SIDE AND REAR SETBACKS:
Minimum side and rear building setbacks shall be
ten (la) feet from property lines.
SECTION 3. All uses of land within the district not
specifically authorized and permitted are prohibited.
SECTION ~. In compliance with the prov~.sions of said
Butte county code, Chapter 24, the same is hereby amended by
adding this Ordinance in fu11.
SECTION ~. The penalties far the violation of the
zoning hereby imposed within the district sha11 be as provided in
the Butte County Code, Chapter 2~, this Ordinance shall from and
after its effective date become a supplement to and part of the
Butte County Code, Chapter 2~.
SECTION 6. This Ordinance shall be and it is hereby
declared to be in full force and effect from and after thirty (3a)
days after the date of its passage, and before the exp~,ratfion of
fifteen (15) days after its passage, this Ordinance shall be
published once with the names of the members of the Board of
Supervisors voting for and against it in the
Gazette , a newspaper published in the County of Butte,
State of California.
