HomeMy WebLinkAbout1866ORDINANCE N0. 186b AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A "C-~." (LIGHT COMMERCIAL} DISTRICT, PURSUANT TO CHAPTER 2~4-2g. 1 The Board of Supervisors of the County of Butte, State ~ of California, under and pursuant to Chapter 2~-29 of the Butte $ County Code of said County DO ORDAIN as follows: 4 SECTION 1. The hereinafter described area situated in 5 the County of Butte, State of California, shall be and it is g hereby zoned as a "C-1" (Light Commercial) District, and such 7 area shall be sub,jeet to the restrictions and restricted uses 8 and regulations hereinafter specified and provided. 9 Said area so zoned being located in the unincorporated 10 area of Butte County, Durham, snore particularly described as 11 follows: 12 Lat 1 of that parcel map recorded in Map Book 59 on Page 17 of the Butte County 13 Recorder. 14 Containing 5 acres, more or less. 15 SECTION 2. REGULATIONS FOR A "C-1" DISTRICT: 16 The following regulations shall apply in a "C-1" 17 District. 18 (A) USES PERMITTED: 19 1. Dwellings and dwelling groups, subject to the 2D building area, lot width and yard requirements 21 specified for residential districts. 22 2. Hotels and motels, clubs, ledge halls, hospitals, 23 sanitariums and clinics. 24 3, Retail stores and shops of light' commercial 25 character and conducted within a building, 26 including appliance stores, banks, barber shops, -1- 1 2 3 4 5 6 7 8 9 10 1 ~. 12 13 14 15 18 I 17 18 19 20 21 ~ 22 23 24 2S 26 beauty parlors, book stores, cleaner or laundry agents and launderettes,. dress shops, drug stores, food stores, furniture stores, millinery shops, professional offices, restaurants, shoe shops, storage garages, studios and tailor shops, public utility commercial offices, and other uses which are of similar character to those enumerated and which will not be detrimental or obnoxious to the neighborhood in which they are to be located. ~1. Outdoor advertising signs, new automobile sales and theaters. (B) THE FALLOWING USES SUBJECT TO SECURING A USE PERMIT 2N EACH CASE: 1. Automobile courts and mobile home parks. 2. Public and quasi-public uses, including churches. 3. Small animal hospitals, dance academies, pet shops, mortuaries, used car sales, used or secondhand goods, refreshment stands, service stations, drive-in restaurants and other uses which are of similar character. (C) THE REQUIREMENTS AF SECTION 2~l-33 OF THIS CODE ARE MADIFIED IN THE FALLOWING PARTICULARS FOR BUILDING SITES IN C-~1 BONES: ~.. Side yard requirements: None, except when the side of a lot abuts upon the side of a lot in an "R" District, in which case the abutting side yard sha11 not be less than five (5) feet; and except where the side yard on the street side of a corner lot abuts on an "R" District, in which case the side yard on the street side shall. be one-half the front yard rdquir.ed.in such "R" Districts. The side yard requirements for residential dwellings shall conform to the requirements for any residential zone. 3. Rear yard requirements: Twelve (12) feet, or five (~) feet adjacent to an alley. SECTION 3, All uses of land within the district not specifically authorized and permitted are prohibited. SECTION ~. Tn compliance with the provisions of said Butte County Cade, Chapter 2~, the same is hereby amended by adding this Ordinance in full. SECTION 5. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the-Butte County Code, Chapter 24, this Ordinance shall from and -3- 1 after its effective date become a supplement to and part of the 2 Butte County Code, Chapter 2~4. 3 SECTION 6. This Ordinance shall be and it is hereby 4 declared to bE in full force and effect from and after thirty (3D) 5 days after the date of its passage, and before the expiration of g fifteen (1~) days after ~.ts passage, this Ordinance sha11 be q published once with the names of the members of the Baard of 8 Supervisors voting for and against it in the Chico 9 Enterprise a newspaper published ~.n the County of Butte, 10 State of California. 11 BASSED AND ADO~'TED by the Bvard of Supervisors of the 12 County of Butte, State of California, on the 20th day l3 of September , 1977, by the following vote: 14 -AYES: Supervisors Madigan, Moseley, Winston and Chairman Richter 15 NOES: None 16 ABSENT: Supervisor Lemke 17 NOT VOTING: None 18 ~~ ERNARD RICHTER, Chairman 19 Butte County Baard of Supervisors 2O ATTEST: CLARK A.
