HomeMy WebLinkAbout1878.lydinance No. 187$ AN ORDINANCE AMENDING CHAPTER 20 OF THE BUTTE COUNTY CODE 1 The Board of Supervisors of the County of Butte, State 2 of California, DO ORDAIN, as follows: 3 Section 1. That §20-95 of the Butte County Code is 4 hereby amended to read as follows: ~ §20-95. When a Parcel Map is Not Required. 6 (a) Subdivisions created by short-term leases 7 (terminable by either party on not more than 30 days' notice in 8 writing} of a portion of the operating right-of --way of a railroad ~', 9 corporation defined as such by §230 of the Public Utilities Code, 10 or for land conveyed to a public agency or public utility, or to a 11 subsidiary of a public utility for c~r~v~yanee to such public utilit 12 for rights--of-way, unless a showing is made in individual cases, 13 upon substantial evidence that public policy necessitates such a 14 parcel map. l~ (b} For any conveyance or agreement made solely for lg the purpose.:of correcting, confirming or relocating a boundary 17 common to abutting lots or parcels provided that the approval 18 of the Advisory Agency is obtained; based upon: i9 (1) The resulting lots or parcels shall comply 20 with the provisions of this chapter and the applicable zoxa,ing 21 regulations, provided however, that if the existing ~;ots or 22 parcels are substandard in size, and all the proposed lots or pare 23 will be equal to or greater in size than the existing lots or 24 parcels, approval may be granted, 2~ (2} No additional lot or parcel: is increased, 2B els 1 2 3 4 5 6 7 8 9 to I1 12 13 14 15 1B 17 18 19 2D 27. 22 23 24 2g {3) If the boundary being adjusted a:s between lots, the applicant shall record a certificate showing the adjustment , (4) If the boundary being adjusted is between parcels, the applicant may be required to file a record of survey showing the ad j us tment . Section 2. That this ordinance shall take' effect 30 days after the date of its adoption, and before the expiration of 15 days after its passage, it shall be published with the names of the members voting for and against the same in the Gridley Herald a newspaper published in the County of Butte, State of California.
