ORDINANCE N0. 1880
AN ORDINANCE ZONING A PORTION OF THE COUNTY OF
BUTTE, STATE OF CALIFORNIA, A "TM-2" (TIMBER
MOUNTAIN} DISTRICT, PURSUANT TO CHAPTER 24-29.
The Board of Supervisors of the County of Butte, State
of California, under and pursuant to Chapter 24--29 of the Butte
County Code of said County DO ORDAIN as follows:
SECTION 1. The hereinafter described area situated
in the County of Butte, State of California, shall be and it is
hereby' zoned as a 't'Il"I-2" (Timber Mountain} District, and such
area shall be subject to the restrictions and restricted uses
and regulations hereinafter specified and provided.
Said area so zoned being located in the unincorporated
area of Butte County, east of Oroville, more particularly
described as follows:
That portion of the easterly 195 ft. of the
westerly 4.12 ft. of the SE lf4- of the SW lf4
of Sec. 17, T19N, RSE, MDB & M, located north
of Forbestown Road.
Containing 2.0 acres, more or less.
SECTION 2. REGULATIONS FOR A "'Il"I-~" DISTRICT:
The following regulations shall, apply in a "TM-2"
[District:
(A) USES PERMITTED:
1. One single-family dwelling per parcel,
including mobile home.
2. Management, raising, harvesting and removal
of trees, shrubs, seedlings, flowers, herbs and all
food crops for human or animal consumption.

3. Beeping and raising small animals for domestic
use, including dogs, cats and household pets, poultry
anal other birds, bees, fish and frogs.
4. Beeping, raising and pasturing of cattle,
horses, sheep, goats, hogs or other livestock,
provided that no more than two (2) such animals be
kept per acre on parcels of less than five (j} acres
anal no more than four {4) such animals be kept per
acre on parcels of five C5) acres or more.
5. Prospecting, claiming, dra.lling, mining,
excavating and dredging of mineral, hydrocarbon and
geothermal resources, except as 1lmited irl Section
(B} below.
6o Protection of land and forests from fire,
erosion, floods, slides, quakes, insects, diseases
and pollution, including arboretums anal natural
wilderness, experimental and study areas.
7. Display and sale of products of agricultural
uses and home arts and crafts produced on the premises.
8. Accessory uses, improvements and structures
customary and pertinent to permitted uses, except as
limited in Section (B} below, including guest houses,
barns, sheds, shops, garages and storage areas.

1 (B} USES PERMITTED SUBJECT TO FIRST SECURING A USE
2 PERMIT IN EACH CASE:
3 to Residential uses other than one single-family
4 dwelling per parcel or one single-family dwelling per
5 two {2} acres for "TM--2", including labor camps,
g commercial guest lodging, group quarters or dwelling
7 waits at greater densities.
8 2. Commercial wood processing plants.
g 3. Commercial kennels and animal hospitals.
lp 4. Commercial livestock feed yards.
~~, 5. Animal product processing plants.
~,2 ~6. Mining, quarrying and excavating activities
13 which might be objectionable by reason of noise,
14 odor, smoke, dust, bright light, vibration, stream
15 pollution or handling of explosives or dangerous
lg materials.
17 7. Commercial boat ramps, docks and landing
18 facilities.
19 8. Aircraft landing facilities.
2p 9. Disposal areas and sewage treatment facilities.
2Z 10. Public and quasi-public uses including schools,
22 parks, playgrounds, recreational facilities, utility
2~ system structures, meeting halls, hospitals, libraries,
24 museums, government offices and similar uses.
23 11. Private or commercial outdoor recreation
26 facilities on. sites off' not less than five {5} acres,

including country clubs, golf courses, riding academies
and stables, hunting and fishing camps and other clubs,
and gun clubs and ranges.
(C} LOT AREA:
Minimum required area of a lot per dwelling unit
shall not be less than two (2) acres for "TM-2"
(D) LO'f WIDTH REQUIRED:
Minimum required lot width shall not be less
than sixty-five {65) feet.
(E) FRONT YARD REQUIRED:
Minimum required front building setback shall
be not less than fifty (50) feet from the centerline
of the road, except where the road is classified by
the County as a Federal .Aid Secondary Road, the
minimum required front building setback shall be not
less than fifty--five C55) feet from the centerline of
the road.
(F} SIDE YARD REQUIRED:
Minimum required side building setback shall be
li not less than five C5) feet for "TM-2."
(G) REAR YARD REQUIRED:
Minimum, required rear building setback shall be
not less than five (5) feet for "TM-2. tf
SECTION 3. All uses of land within the district not
specif~.cally authorized and permitted are prohibited:.

SECTION 4. In compliance with the provisions of said
Butte County Code, Chapter 24, the same is hereby amended by
adding this Ordinance in full.
SECTION 5. The penalties far the violation of the
zoning hereby imposed within the district shall be as provided
in the Butte County Cade, Chapter 24, this Ordinance shall from
and after its effective date become a supplement to and part of
the Butte County Code, Chapter 24.
SECTION 6. This Ordinance shall be and it is hereby
declared to be in full force anal effect from and after thirty (30)
days after the date of its passage, and before the expiration of
fifteen (15) days after its passage, this Ordinance shall be
published once with the names of the members of the Board of
Supervisors voting for anal against it in the Oroville Mercury
Register, a newspaper published in the Coun~y~ of Butte, State
of California.
