HomeMy WebLinkAbout1881ORDINANCE NO. 1881 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A "C-1" tLIGHT COMMERCIAL) DISTRICT, PURSUANT TO CHAPTER 24-29. 1 The Board of Supervisors of the County of Butte, State 2 of California, under and pursuant to Chapter 24-29 df the Butte 3 County Cade of said County DO ORDAIN as~f~llows: 4 SECTION 1. The hereinafter described area situated in 5 the County of Butte, State of California, sha11 be and it is 6 hereby zoned as a "C-1" (Light Commercial) District, and such 7 area shall be subject to the restrictions and restricted uses 8 and regulations hereinafter specified and provided, 9 Said area so zoned being located in the unincorporated 10 area of Butte County, Chico, more particularly described as 11 follows: 12 Lats 1 and 2 of"Vista Ref Monte Sub." per Map of Record in Map Book 17 on 13 Page 6 of the Butte County Recorder. Excepting therefrom the northerly 145 14 ft. of said Lots 1 and 2 and the southerly 100 ft. of said Lot 1. 15 Containing 1.10 acre, more ar 1ess. 16 17 SECTION 2. REGULATIONS FOR A "C-1" RISTRICT: 18 The following regulations shall apply in a "C-1" 19 District. 20 {A) USES PERMITTED: 21 1. Dwellings and dwelling groups, subject to the building 22 area, tat width and yard requirements specified for 23 residential districts. 24 ~, Hotels and motels, clubs, lodge halls, hospitals, 25 sanitariums and clinics. 2s 3, Retail stores and shops of light commercial character -l - 1 and conducted within a building, including appliance 2 stores, bans, barber shops, beauty parlors, book 3 stores, cleaner or laundry agents and launderettes, 4 dress shops, drug stores, food stores, furniture 5 stores, millinery shops, professional offices, 6 restaurants, shoe shops, storage. garages, studios 7' and tailor shops, public utility commercial- offices, 8 and other uses which are of similar character to those 9 enumerated and which will not be detrimental or l0 obnoxious to the neighborhood in which they are to be 1~. located . 12 4. Outdoor advertising signs, new automobile sales and 13 theaters. 14 (8} THE FOLLO~fING USES SUBJECT TO SECURING A USE PERMIT 15 IN EACH CASE: 16 1. Automobile courts and mobile home parks. 17 2. Public and quasi-public uses, including churches. 18 3. Small animal hospitals, dance academies, pet shops, 19 mortuaries, used car sales, used or secondhand goods, 20 refreshment stands, service stations, drive-in 21 restaurants and Other uses which are flf similar 22 character. 23 (C} THE REQUIREE~ENTS OF SECTION 24-33 OF THIS CODE ARE 24 MODIFIED IN THE FOLLO~lING PARTICULARS FOR SUItDING 25 SITES IN C-1 ZONES. 26 1. The lot width requirements for residential dwellings shall conform to the requirements for any residential zone. 2. Side yard requirements: None, except when the side of a lot abuts upon the side of a lot in an "R" Qistrict, in which case the abutting side yard shall not be less than five {5) feet; and except where the side yard on the street side of a corner lot abuts on an "R" District, in which case the side yard on the street side shall be one-half the front yard required in such "R" Districts. The side yard requirements for residential dwellings shall conform t~o the requirements for any. residential zone. 3. Rear yard requirements: Twelve {12) feet, or five {5) feet adjacent to an alley. SECTION 3. All uses of land within the district not specifically authorized and permitted are prohibited. SECTION 4. In compliance with the provisions of said Butte County Code, Chapter 24, the same is hereby amended by iadding this Ordinance in full. SECTION 5. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in .. 3 1 2 3 4 5 s 7 8 9 10 11' 12 1.3 I4 15 16 17 18 19 2d. 2Z 22 23 24 23 26 the Butte County Code, Chapter 24, this Ordinance shall from and after its effective date become a supplement to and part of the Butte County Code, Chapter 24. SECTION 6. This Ordinance shall be and it is hereby declared to be in full farce and effect from and after thirty (30} days after the date of its passage, and before the expiration of fifteen (15} days after its passage, this Ordinance shall be published once with the names of the members of the Board of Supervisors voting for and against i t i n the Chico _ _- Enfer rise , a newspaper published i n the County of Butte, State of California.
