HomeMy WebLinkAbout1889ORDINANCE N0. 1889 1 2 3 4 s 6': 7' 8 9 10 IZ 12 ].3 3.4 15 I6 Z7 is 19 20 21 22 23 24 25 28 AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "A-5" (AGRICULTURAL} DISTRICT The Board of Supervisors of the County of Butte, State of California, under and pursuant to Chapter 24-30 of the Butte County Code, and declaring an emergency, DO ORDAIN as follows: SECTION 1. The hereinafter described area situated in the County of Butte, State of California, shall be and it is.. hereby Zoned as an "A-5" (Agricult-oral} Distr~.ct for a period of 90 days, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located north of Chico, more particularly described as follows: Parcel l: That portion of Section 25, T23N, R1W, MDB & M located south of Meridian Road, east of State Highway 99, and north of Rock Creek. That portion of the westerly 1309058 ft. of Sec. 30, T23N, RIE, MDB & M located north of Rock Creek, excepting therefrom the northerly 882.83 fto of said Sec. 30. Parcel 2: That portion of the W~ of Sec. 14, T23N, R1W located east of State Highway 99. Containing 126.53 acres, more or less, north of Chico. -SECTION 2. REGULATIONS FOR AN "A-5" DISTRICT: (A} USES PERMITTED: 1. One single--family dwelling per parcel. 2. Accessary buildings and uses pertinent to the permitted uses, including agricultural processing plants. 4p Housing facilities {including mobile homes) to accommodate only agricultural employees and their families employed by the owner or operator of the premises; and provided further that such housing facility shall be considered accessory to the main building and shall conform to the provision pertaining to required yard and apen space for dwellings. 5. Mobile Homes to house one family when such mobile home is the only housing facility located on the premises, provided the following conditions are conformed) to: i a) The floor area within the mobile home shall not be less than five hundred C500) square feet. b) The parcel of land conforms to Section 24~-72(C) (M~.nimum lot area of 5 acres) , or is a smaller parcel of land lawfully created. (B) The following uses are permitted subject to securing a use permit in each case: 1. Golf Courses and country clubs. 2. Public or quasi-public uses including churches, fire houses, hospitals and clinics, parks and play- grounds, schools, public utility buildi.ngso _2- 1 2 3 4 5 6 7 8 9 10 II 12 13 14 1.5 16 1.7 ~.8 ~9 2fl 21 ~''~, 22 23 24 25 26 (C) The requirements of Section 24-33 of this code notwithstanding, the minimum lot .area in A-5 zones shall not be less than five acres. SECTION 3. All uses of land within the district not specifically authorized and permitted are prohibited. SECTION 4. In compliance with the provisions of said Butte County Code, Chapter 24, the same is hereby amended by adding this ordinance in full. SECTION 5. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Butte County Code, Chapter 24, this Ordinance shall from and after its effective date become a supplement to and part of the Butte County Code, Chapter 24. SECTION 6. This urgency ordinance shall take effect immediately upon its passage, and before the expiration of fa.fteen {15) days after its passage shall be published ante with the names of the members of the Board of Supervisors voting for and against the same in the Chico Enterprise-Record, a news- paper i.n general circulation in the County of Butte, State of California. The Fact constituting the urgency on which this ordinance is based is: 1.
