HomeMy WebLinkAbout1890n~~dinance No . 1890 AN URGEI~C~ ORDINANCE PROHIBITING INT~;RFERENCE WITH EXISTING ~?ATER COURSES WITHIN THE BOUNDARIES OF COUNTX SERVICE AREA 26 ~. The Board of Supervisors of the County of Butte, State 2 of California, DO ORDAIN as follows: 3 Section 1. Within the area in the unincorporated area ~ of Butte County known as Thermalito, potential flooding hazards 5 will occur if the existing water courses are filled or blocked. 6 This area is experiencing very rapid growth, caused in part by 7 the recent sewer project servicing the area. There is a strong 8 need, based upon the public's health and safety, that existing 9 water courses and their storm water carrying capacities be pre- la served pending a complete drainage study and plan for the area. lI Section 2. It shall be unlawful to alter,; block, fill, 12 divert or otherwise impair the existing water courses within the 13 area described herein. 14 The water courses referred to in this ordinance shall be 15 as delineated on that certain map entitled "Thermalito Drainage 18 Study", prepared by Geddes and Driscoll, dated September 2l, 1977, 27 copies of which are on file with the County Clerk, the County 18 Department of Public Works, the County Planning Department, and 19 the County Health Department, and referred to on said map as 20 "major drainage courses." 2I Section 3. This ordinance .shall apply to that. certain 22 real property as is located within the unincorporated area 23 described in Exhibit "A", which is incorporated herein as is set 24 forth in full. 25 26 1 Section 4, Any violation of this ordinance is a mis~- 2 ..demeanor punishable by a fine of not more than one hundred 3 dollars ($100.00) or by imprisonment in the county jail for not ~ more than thirty (30) days, or by both such fine and imprisonment. ~ Section 5. If any section or part of this ordinance B shall be for any reason judicially determined to be invalid, such 7 invalidity shall not affect the remaining portions hereof. 8 Section b. This urgency ordinance shall take effect 9 immediately upon its passage, and before the expiration of fifteen 10 (15) days after its passage shall be published once with the name I1 of the members of the Board of Supervisors voting for and against 12 the same in the Orovi~~e Mercury a newspaper 13 in general circulation in the County of Butte, State of 14 California. 15 The facts constituting the urgency on which this ordin- 1B ante is based are: the rapid development of property within 17 the area, primarily due to the availability of the recent sewer 18 system servicing the axea and the winter rains which have 19 commenced and which are expected to continue during the winter 20 months.
