RESOLUTION AUTHORIZING THE CONVEYANCE OF REAL PROPERTY FROM THE COUNTY OF BUTTE
WHEREAS, on April 10, 2018 the Board of Supervisors accepted the donation of real property identified as
Assessor's parcel number 003-0�43-009, with a physical address of 182 East 4th Avenue, Chico, California 95936
("Property"), which was bequeathed to the Butte County Department of Behavioral Health ("Department"), by Elizabeth
Sawyer VVu|fe and Stephen K0asta|ir, Cu -Trustees of the Elizabeth Sawyer Wolfe 1999 Trust Dated February 8, 1999
WHEREAS, Resolution No. 18-076^ authorized the Director General Services Department to execute the
Certificate of Acceptance in order to effectuate the conveyance of the Property to the County of Butte on June 6, 2018 by
recordation ofaGrant Deed; and
WHEREAS, the Department participates imavariety ofhousing programs linked with supportive services toassist
adults and youth with severe and persistent mental illness who are either homeless, chronically homeless orat risk of
homelessness. The Department fosters relationships with property owners, property management companies and
supportive living residence operators to refer individuals to housing that meets their needs and does not typically own or
manage these properties; and
WHEREAS, on July 20, 2018, the County released a Request for Proposals (RFP#O�1-19), to solicit an organization
as defined in US Code Title 26 aind is structured to provide Health and Human Services; that would honor the 0mmmr,
assume fee ownership of the Property and provide the housing component of the permanent housing supportive services
program, at no cost to the County; and
WHEREAS, the awarded Respondent Organization, Chico Housing Action Team \ a California nonprofit
581(c)(3)public benefit corporation, agrees tupurchase the Property; "4sls,Where-Is and with all Faults and 0mhationn",
upon the terms and conditions stated in the Memorandum of Understanding ("MOU") executed by the County and CHAT.
The conveyance document shall contain a deed restriction and a reversionary clause wherein should CHAT fail to comply
with the terms and conditions contained in the M(JU Vrshould the MOU beterminated, title to the Property shall revert
tnthe County; and
WHEREAS, in the alternative, commencing with the recordation of the conveyance document and for aperiod of
28 consecutive years, should CHAT perform its dudes and obligations under the MOU, to the satisfaction of the
Department, the County shall execute any documents necessary to remove the deed restriction and reversionary clause.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, that it
is in the best interest of the citizens of the County of Butte to approve the conveyance of the Property pursuant to
Government Code Section 25365.(a) upon the price and terms stated herein; and
BE IT FURTHER RESOLVED that the Director of General Services, is hereby authorized to execute any and all
documents necessary to convey the Property to CHAT and close the escrow.
