HomeMy WebLinkAbout1906ORDINANCE N0. 1906 1 2 3 4 5 6 7', 8 9 10 l~. 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A "C-2" (GENERAL COMMERCIAL) DISTRICT The Board of Supervisors of the County of Butte, State of California, under and pursuant to Chapter 24-30 of the Butte County Code, anal declaring an emergency, DO ORDAIN as f allows: SECTION 1. The hereinafter described area situated in the County of Butte, State of California, ,shall be and it is hereby zoned as a t`C-2" (General Commercial) District for a period of 8 months, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located northwest of Chico, more particularly described as follows: All that area outside the City of Chaco that lies within the follow~.ng portions of Bidwell's 14th Subdivision per Map of Record on Page 12 and 13 of Map Book 8 of the Butte County Recorder: Lots 9 through 16 of Block 9. Lots 9 through l6 of Block 10. Lots 1 through 8 of Block ll. Lot 8 of Black 12, containing 7.56 acres, more or less. SECTION 2. REGULATIONS FOR A "C-2" DISTRICT: The fallowing regulations shall apply in a "C-2" II District: (A) USES PERMITTED: 1. Dwellings and dwelling groups, subject to the building site, area, lot width and yard requirements specified for residential districts. l 2 3 4 5 el 7' 8 9 10 11 22 13 14 15 16 ].7 18 19 20 21 22 23 24 25 26 Z. All uses permitted in "C-1" {Light Commercial) Districts. 3. General Commercial uses including art shops, aviaries, bar and cocktail lounges, billiard parlors and pool halls, bowling alleys, building material (retail), cleaning and pressing establishments, dance halls, interior decorating shops, employment agencies, governmental legislative buildings, gymnasiums, public, commercial or physical cultural studios, hospitals, hotels and motels, laboratories and ~-ray facilities, massage parlors and reducing salons, equipment rentals, pet shops, used car lots, repair garages, auto car washes, plumbing shops, cabinet shops, sign manufacturing shops, and other retail establishments when interpreted as similar, 4. Accessory uses and buildings pertinent to a permitted use . {B) 'I~I~ FOLLOWING USES SUBJECT TO SECURING A USE PERI"II'f ZN EACH CASE: 1. Welding shops. 2. Manufacturing of clothing, handicraft products, printixig,lithographing and other light manufacturing or industrial uses of similar character. 3. Public or quasi-public uses including churches. 4. Service stations, drive-in restaurants, kennels, and small animal hospitals and mortuaries. -2- 1 2 3 4 5 6 7 8 9 10 Yl 12 13 14 15 16 I 17 18 19 20 2L 22 23 24 25 26 (C) THE REQUIREMENTS OF SECTION 2~-23 OF THIS CODE ARE MODIFIED FOR ALL BUILDING SITES TN C-2 ZONES IN THE FOZZOWING PARTICULARS: 1. Lot width required: Minimum lot width shall not be less than twenty-five (25) feet. The lot width requirements for residential dwellings shall conform to the requirements for any residential zone. 2. Side yard requirements: None, except where the side of a Lot abuts upon the side of a lot in an "R" District, in which case the abutting side yard i shall not be less than five C5) feet; and except where the side yard on the street side of a corner lot abuts on an "R" district, in which case the side yard on the street side shall be one-half the front yard required in such "R" Districts. The side yard requirements for residential dwellings shall conform to the requirements for any residential zone. 3. Rear yard required: Twelve (12) feet, or five C5) feet adjacent to an alley. SECTION 3. All uses of land within the district not specifically authorized and permitted are prohibited. SECTION 4. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Butte County Code, Chapter ~4, this Ordinance shall from and after its effective date become a supplement to and part of the Butte County Code, Chapter 24. SECTION 6. This urgency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen (15) days after its passage shall be published once with the names of the members of the Board of Supervisors voting for and against the same in the Chico Enterprise Record, a newspaper in general circulation in the County of Butte, State of-Calif ornia. The fact constituting the urgency on which this Ordinance is based is: 1. To protect the health, welfare, and safety of the public.
