AN URGENCY ORDINANCE AMENDING SECTION 19-19 OF
THE BUTTE COUNTY CODE SEWAGE DISPOSAL--VARIANCES
I The Board of Supervisors of the County of Butte, State of
2 California, DO ORDAIN as follows:

3 Section 1: That §19-19 of Chapter 19 of the Butte County
4 Code is hereby amended to read as follows:
5 §19-19. Variances. A variance may be granted to any of
6 the provisions of Sections 19-10 and 19-12 of this chapter by the
7 board of supervisors, Anyone applying for variance to this
8 chapter shall petition therefor directly to the board of supex-
9 visors, and said petition shall be accarnpanied by a fee of twenty--
10 five dollars which zs not returnable in the event the variance is
Il not granted. Upon receipt of such a petition the board of super-
12 visors shall set same for public hear~,ng and shall advertise
13 notice of such hearing pursuant to Government Code Section 6061.
I4 And provided further, such hearing shall not be scheduled earlier
15 than ten days from the date of publication.
16 Variances granted hereunder.shalL contain provisions
17 which will accomplish the following:
18 (1) That the mobile home may be placed on the property
19 without violating any of the setback requirements of the zones in
20 which the property is Located.
2I (2) That the mobile:~.Iiome shall only be allowed where
22 the zone in which the property is situate allows for the placing
23 and utilization of a mobile .home; provided, however, that there
24 .shall be no requirement for an additional site for said mobile
home as the term "site" is utilized in this chapter, or any other
28 county ordinance or code provision, in that this allowed use is

temporary in nature.
(3) That the mobile home to be placed on the property

may only be utilized by a relative, ea.ther by marriage or by
blood ar close friend, of the owner of the property on which it
is to be placed, and there may be no rent charged to the occupant
of the mobile home. The mobile home may be owned by either the
owner of land on~:~'hich it is to be placed, or the relative or
close friend who shall be residing therein.
(4) The variance granted hereunder shall be for the to
of one year. The board of supervisors, upon application of the
property owner and without a public hearing, may grant an extens
of such variance for periods not exceeding one year. zn the event
the applicant who is residing within the mobile home, or the con-
ventional residence far any reason moves to another location or is
deceased, then in that event, the variance granted herein automati
tally expires and the mobile home shall be removed within one
hundred twenty (120) days. In the event the mobile home is not
removed within one hundred twenty (120) days pursuant to the terms
of the variance, the county shall remove said mobile horEi.e and
store it at the owner's expense. The county shall require either
a deposit or bond sufficient to cover the removal expense at the
time the application for the variance is approved. The amount of
such deposit or bond shall be determined at the time of the
hearing for the variance. The request far the variance shall be
signed by both the applicant and the relative or other person to
receive or render assistance, and shall provide that Butte County

3 the applicant.
4 Section 2. This urgency ordinance shall take effect imme-
b diately upon its passage, and before the expiration of fifteen
6 (15) days after its passage sha11 be published once with the names
7 of the members of the Board of Supervisors voting for and against
S the same in the Chico Enter rise Record a newspaper in
9 general circulation in the County of Butte, State of California.
10 The facts constituting the urgency on which this ordinance is_~
3.1 based are:
12 1. To protect the health, safety and welfare of the
13 residents of Butte County.
14 2. That this Board finds and determines that thirty (30)
15 days is nat sufficient time for removal in that it wi11 usually
18 require mare tune to:handle the affairs of a decedant. To continue
17 the thirty:'(30} day mandatory removal will create severe hardship
18 to those involved.
19 PASSED AND ADOPTED by the Butte County Board of Super-
20 visors this 4th day of April ._, 1978, by the follow-
