HomeMy WebLinkAbout1918ORDINANCE N0. 1918 1 2 3 4 5 6 7 8 9 la 1X, 12 13' 14 15 16 17 18 19 20 23. 22 23 24 23 26 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A "TM-40" (TIMBER MOUNTAIN) DISTRICT, PURSUANT TO CHAPTER 24-29. The Board of Supervisors of the County of Butte, State of California, under and pursuant to Chapter 24-29 of the Butte County Code of said County DO ORDAIN as follows: SECTION 1. The hereinafter described area situated in the County of Butte, State of California, shall be and it is hereby zoned as a "TM-40" (Timber Mountain) District, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte County, Chico, more particularly described as follows: Lots 16, 17, 18, 19 and 20 of that Parcel Map recorded in Map Book 55 on Pages 70, 71, 72 and 73 of the Butte County Recorder. Containing 233.66 acres, more or less, Chico. SECTION 2. REGUhATIONS FDR A "TM-40" DISTRICT: The following regulations shall apply in a TM-40 I District: (A) Uses permitted: 1. One single-family dwelling per parcel, including mobile homes. 2. Management, raising, harvesting and removal of trees, shrubs, seedlings, flowers, herbs and all food crops for human or animal consumption. 3. Keeping and raising small animals for domestic use, including dogs, cats and household pets, poultry and other birds, bees, fish and frogs. 1 4. Keeping, raising and paturing of cattle, horses, 2 sheep, goats, hogs or other livestock, provided that no 3 more than two {2) such animals be kept per acre on 4 parcels of leis than five {5) acres and no more than 5 four (4) such animals be kept per acre on parcels of 6 five (~) acres or more. 7 5. Prospecting, claiming, drilling, mining, 8 excavating and dredging of mineral, hydrocarbon and 9 geothermal resources, except as limited in Section (B) 10 below~w 11 6. Protection of land and forests from fire, 12 erosa~on, floods, slides, quakes, insects, diseases ~:~~~ 13 and pollution, including arboretums and natural 14 wilderness, experimental and study areas. 15 '~. Display and sale of products of agricultural 16 uses and home arts and crafts produced on. the premises. 17 S. Accessory uses, improvements and structures 18 customary' and pertinent to permitted uses, except as 19 limited in Section (B) below, including guest houses, 20 barns, sheds, shops, garages and storage areas. 21 (B} Uses permitted subject to first securing a use 22 permit in each case: 2~ 1. Co~imercial wood processing plants. 3. Commercial kennels and animal hospitals. 4. Commercial livestock feed yards. ~, Animal product processing plants. 6. Mining, quarrying and excavating activities which might be objectionable by reason of noise, odor, smoke, dust, bright light, vibration, stream pollution or handling of explosives or dangerous materials. 7. Commercial boat ramps, docks and land~.ng facilities. 8. Aircraft landing facilities. 9. Disposal areas anal sewage treatment facilities. 10. Public and quasi-public uses including schools, parks, playgrounds, recreational facilities, utility system structures, meeting halls, hospitals, libraries, museums, government offices and similar uses. 11. Private or commercial outdoor recreation facilities on sites of not less than five C5) acres, including country clubs, golf courses, riding academies and stables, hunting and fishing camps and other clubs, and gun clubs: and ranges. (E} Front yard required: Minimum required front building setback shall be not less than fifty (50) feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum required front building setback shall be not less than fifty-five C55) feet from the centerline of the road. (F} Side Yard required: Minimum required side building setback shall be not less than twenty-five {25) feet for "TM-40." (G) Rear yard required: Minimum required rear building setback shall be not less than fifty C5o} feet for "~`M-40." SECTION 3. All uses of land within. the district not specifically authorized and permitted are prohibited. SECTION 4. In compliance with the provisions of said Butte County Code, Chapter 24, the same is hereby amended by adding this ordinance in full. SECTION 5. The penalties for the violation of the zoning hereby imposed within the distr~.ct shall be as provided in the Butte County Code, Chapter 24, this ordinance shall from and after its effective date become a supplement to and part of the Butte County Code, Chapter 24. -t~_ 11 2 3 4 s 6 7 8 9 7.0 is ~2 13 14 15 ~6 i~ 18 ~9 20 2~. 22 23 24 25 26 SECTION 6. This ordinance sha1.1 be and it is hereby declared to be in full farce and effect from and after thirty C30} day's after the date of its passage, and before the expiration of fifteen (15) days after its passage, this ordinance shall be published once with the names of the members of the Board of Supervisors voting for and against a.t in the Chico Enterprise Record, a newspaper published in the County of Butte, State of California.
