HomeMy WebLinkAbout19-232WHEREAS, the Butte County Board of Supervisors have entered into a project agreement with Caltrans and the
Federal Highway Administration to participate in the Highway Bridge Program (HBP) for the construction of the Midway
Road Bridge across Butte Creek and Butte Creek Overflow; and
WHEREAS, the project agreement requires that the County of Butte acquire all and easements
necessary to construct the project; and
WHEREAS, the County ofButte must complete all and easement acquisitions necessary tVdeliver
the righ1-nÆ’uvaycertification toCaltrans.
NOW, THEREFORE, BE IT RESOLVED the Butte County Board of Supervisors, makes the following findings:
The Board of Supervisors finds that the location of the public improvements in this case, the Midway Road
Bridge Replacement Project, is not based primarily on a consideration of the lower cost of acquiring land in
anagricultural preserve. Midway Road already exists, and it isnot being moved. The road crosses Butte Creek
and Butte Creek Overflow BR2-5912(085)wvhich require bridges. The existing bridges were constructed in
1915 and 1918 respectively and need to be replaced. The bridges need to be replaced where they would
connect to the existing road. There is no other location where theme bridges could be built, and the
consideration of the cost of acquiring land in, an agricultural preserve did not play a role in acquiring the land
for the bridge replacement.
The Board finds that there is no other land within or outside of an agricultural preserve on which hit is
reasonably feasible to locate the public improvements, The bridges must connect up to the existing Midway
Road, aind they can only do so if they are located in the proposed location which is the subject of the purchase
and sale agreement.
