HomeMy WebLinkAbout1947ORDINANCE N0. 1947 AN INTERIM ORDINANCE ZONING A FORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "A--40" (AGRICULTURAL) DISTRICT 1 sn 4 5 s 7 8 9 10 lI 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 The Board of Supervisors of the Gaunty of Butte, State of California, under-and pursuant to Chapter 24-30 of the Butte County Cade, and declaring an emergency, DO ORDAIN as follows: SECTION 1. The hereinafter described axea situated in the County of Butte, State of California, shall be and it is hereby zoned as an "A-40" (Agxicultural) District for a period of 'one year, and such axea sha11 be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. The followi-ng regulations shall apply in .an ''A-40" District: {A) USES PERMITTED 1. One single-family dwelling per parcel, including mobile homes. 2. General agriculture farming, horticulture, commdreial livestock, poultry production, growing and harvesting forestry products, warehouse-ng and storage. 3. Accessory buildings and uses pertinent to the permitted uses, including agricultural pro-- cessing plants. 4. Housing facilities {including trailers) to accommodate only employees and their families employed by the owner or operator of the premises; and provided further that such housing facility shall be considered accessory to the maa.n building and shall conform to the provisions pertaining to required yard and open space for dwellings. 5. Mining, quarrying,_commercial excavation and wood processing plants. 6. Hunting and fishing camps, including those which accommodate recreational vehicles and travel trailers, providing that sand -3- 1' 2 3 4 5 6 7 8 9 10 11 12 Z3 3.4 15 16 17 18 19 20 21 22 23 24 25 26 recreational vehicles and travel trailers shall not- be .used for_ year-round. occupancy (B) MINIMUM LOT AREA REQUIRED Minimum lot area shall not be less than forty (40) acres. (C) FRONT YARD SETBACK Minimum front yard setback shall be fifty (SO) feet from the centerline of the road, except where the road is classified by the County as a Federal. Aid Secondary Road, the minimum building setback requirements shall be fifty-five (55) feet from the centerline of the road. (D) SIDE AND REAR YARD REQUIRED Minimum side and rear yard shall not be less than twenty-five {25) feet. SECTION 3. A11 uses of land within the district not specifically authorized and permitted are prohibited. SECTION 4. In compliance with the provisions of said Butte County Code, Chapter 24, the same is hereby amended by adding this ordinance in full. SECTION 5: The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Butte ,County Code, Chapter 24, this Ordinance shall from and after its effective date become a supplement to and part of the Butte County Code, Chapter 24. _ 4 .. 1 2 3 4~ 5 6 7 8 9 10 11 12 13 l.4 15 16 17 18 19 20 21 22 23 24 25 26 SECTION 6. This urgency ordinanceshall take effect immediately upon its passage,-and 3~efore the.expiratian of fifteen. (l 5) days after its passage shall be published once with the names of the members of the Boaxd of Supervisors voting fox and against the same in the Chico Enterprise Record, a newspaper in general circulation in the County of Butte, State of California. The fact constituting the urgency on which this Ordinance is based is: 1. To protect the health, safety, and welfare of the public.
