the Board of Supervisors of the County of Butte, State
of California, under and pursuant to Chapter 24-30 of the Butte
County Code, and declaring an emergency, DO ORDAIN as follows:
SECTION 1. The hereinafter described area situated in
the County of Butte, State of California, shall be and it is hereby
zoned an "R-N" (Residential--Nonconforming) District for a period
of ~n~e y:ear, and such area shall be subject to the restrictions
and restricted uses and regulations hereinafter specified and
provided.
Said area so zoned being located in the unincorporated
area of Butte County, more particularly described as follows:
Lots 1 through 6 of Block 6 of "E1 Medio
Subdivision No. 1" per Map of Record on Page
17 of Book .6 of the Butte County Recorder.
Lots 1 through 14 of Block 8 of said "El
Medio Subdivision No. l."
Blocks 11 through 20 of "El Medio Subdivision
No. 2" per Map of Record on Pages 15 and 16 of
Book A of the Butte County Recorder.
Lots 1 t}~ough 14 ~of Block 9 of said "El Medio
Subdivision No. 2."
Lots 4 through 12 of Block 10 of said "El Medio
Subdivision No. 2."
Blocks 21 through 35 of "Bowers Addition to
Oroville" per Map of Record on Page 15 of Book
`~ of the Butte County Recorder.
Blocks 1, 2, 3, 4, `J through 14, 17, 18, 19, 20,
21, 22, 23 and 24 of '?Howes Addition" per Map of
Record on Page 99 of Book 0 of the Butte County Recorder.
Lots 1 through 7 of Block 5 of said "Howes ,Addition."
Lots 1 through 6 and 12 through 17 of Block 6 of
said "Howes .l-addition. TMr

located south of Ithaca Street, east of Faunce
Way and north of Lot 7 of said "Faunce Subdivision."
Containing 180 acres, more or less, Oroville.
SECTION 2. REGULATIONS FOR AN "R-N" DISTRICT:
The following regulations shall apply in an "R.-N"
l District:
{A) USES PERMITTED
1. One single-family dwelling per parcel, not
including tents, trailers or mobile homes.
2. Accessory buildings pertinent to the permitted
uses.
3. Household pets {but not including livestock,
poultry or poisonous reptiles).
{B) USES SUB~'ECT TO SECURING A USE PERMIT IN EACH CASE
1. Duplex dwellings and multiple family dwellings.
2. Public and quasi-public uses including churches,
firehouses, hospitals, parks and playgrounds, schools
and public utility b~.ildings.
(C) LOT AREA AND WIDTH
The standard provisions of Section 24-33 sha11 apply.

{D) YARD REQUIREMENTS
1. Front: The standard provision of Section 24-33
shall apply, except the setback of nonconforming
existing structures shall determine the minimum yard
required where such structures are being rehabilitated
or expanded.
2. Side: The minimum side yard required is three
{3) f-~. provided the sum of both side yards shall be
equal to or greater than 1C per cent of the average
lot width. Where nonconforming existing structures
are being rehabilitated or expanded, the mini3num side
yard shall be the existing setback .distance on that side.
3. Rear: The standard provisions of Section 24-33
shah. apply.
(E) OFF-STREET PARKING
The provisions of Section 24-35 notwithstanding,
one off-street parking space shall be required per
dwelling unit. This requirement is waived. where
existing off-street parking space is absorbed by
expansion of an existing dwelling as part of an approved
rehabilitation project of the County's Housing and
Community Development Program.
SECTION 3, All uses of Land within the district not
specifically authorized and permitted are prohibited.

SECTION 4. In compliance with the provisions of said
Butte County Code, Chapter 24, the same 3s hereby amended by.
adding this ordinance in full.
SECTION 5. The penalties for the violation of the zoning
hereby imposed within the district shall be as provided in the
Butte County Code, Chapter 24, this ordinance shall from and after
its effective date become a supplement to and part of the Butte
County Code, Chapter 24.
SECTION 6. This urgency ordinance shall take effect
immediately upon its passage, and before the expiration of fifteen
x(15) days after its passage shall be published once with-the names
of the members of the Board of Supervisors voting for and against
the same in the Oroville Mercury Register, a newspaper in general
circulation in the County of Butte, State of California. The facts
constituting the urgency on which this ordinance is based are:
1. An essential part of the County's Housing and
Development Program in the South Oroville area is the
rehabilitation and expansion of existing dwellings.
~o Most of the sites of dwellings to be rehabilitated
are small subdivision lots which are substandard in
width and size and do not conform to current design
standards .
3. .The application of _the Co~n.t~r's standard requirements
for setbacks and off-street parking would require numerou
variances for HCD rehabilitation projects.
