AN ORDINANCE 20NING A PORTION OF THE COUNTY OF
BUTTE, STATE OF CALIFORNIA, A f'TM-40" [TII+'IBER
I~~OUNTAIN) DISTRICT, PURSUANT TO CHAPTER 24-29.
1 The Board of Supervisors of the County of Butte, State
2 of California; under-and pursuant to Chapter 24-29-of the Butte.

County Cade of said County DO ORDAIN as follows:
4 SECTION 1. The hereinafter described area situated in
5 the County of Butte, State of California, shall be and it is
6 hereby zoned as a "TRH-40" (Timber A?ountain - 40 acre parcels)
7 District, and .such area sha11 be subject to the restrictions and
8 restricted uses and regulations hereinafter specified and provided..
9 Said area so zoned being located in the unincorporated
10 area of Butte County, Oroville, more particularly described as
11 folloirs
12 All of the northwest quarter of Section 35 except
13 A portion of the East half of the northwest quarter
of Section 35, more particularly described as
14 follows:
15 Commencing at the quarter corner common to Sections
2b and 35, of said township and range, south 45°
16 west, 1257 feet; thence south 46° 30' west, 3l3 ft.
to the point of beginning for the parcel of land
17 herein described; thence due south, a distance of
484 feet to a point; thence due east, a distance
18 of 450 feet to a paint; thence due north, a distance
of 484 feet, to a point; thence due west, a distance
19 of 4S0 feet to the point of beginning.
20 And also excepting therefrom
21 - The southwest quarter of the northwest quarter; and -
the south l0 acres of the northwest quarter of the
22 northwest quarter, all in Section 35,
23 And also excepting therefrom
24 All that portion o~f the northwest quarter of the
northwest quarter of Section 33, described as follows:

Beginning at a point on the north line of the south
10 acres of the northwest quarter of the northwest

Binet Road, from -~rhich the quarter section coiner
between Section 34 and 35, said township and Range,
bears south l5° 16' west, a distance of I730.90 feet;
thence along the centerline of said road, the following
courses and distances: North 8° 43' east, 183.60 ft.;
north 70° 14' east, 63.25 ft.; south 30° 03' east,
88.40 feet; and south S3° 24' east, 297.50 ft. to a
point in the north Line of said south i~0 acres of the
northwest quarter of the northwest quarter of saa_d
Section 35; thence along said north Line, south 88°
35' west, a distance of 413.38 feet to tl~.e point of
~ beginning.
SECTION 2. REGULATIONS FOR A "TAB-40" DISTRICT:
The following regulations shall apply in a "TA~i-40"
District.
(A) U5E S FE R~iI TTE D
1. One single family dwelling per parcel, including
mobile home.
2. A4anagement, raising, harvesting and removal of trees,
shrubs, seedlings, flowers, herbs and all food crops
for human or animal consumption.
3. Keeping and raising sma.Il animals fax domestic use,
including dogs, cats and household pets, poultry and
other birds, bees, fish and frogs.
4. Keeping, raising and pasturing of cattle, horses
sheep, goats, hogs ox other livestock, provided that
no more -than .t~tti~a (2 ) such animals be kept per -acre

on parcels of less than five (5) acres and no more
... _ than. four (9~).. such..animals, be kept per, acre on parcels
of five (5) acres ar more.
5. Prospecting, claiming, drilling, mining, excavating
and dredging of mineral, hydrocarbon and geothermal
resources, except as limited in Sectian (B) below.
6. Protection of land and.farests from fire, erasion,
floods, .slides, quakes, insects, diseases and
pollution, including arboretums and natural wilder-
ness, expeximental and study areas.
7. Display and sale of products of agricultural uses
and home arts and crafts produced on the premises.
8. Accessory uses, improvements and structures customary
and pertinent to permitted uses, except as limited
in Sectian (B) below, including guest houses, barns,
sheds, shops, garages and storage areas.
(]3} USES PERA4ITTED SUBJECT TQ FIRST SECURING A USE
PERI~'~IT IN EACH CASE :
1. Residential uses other than one single-family dwell-
ing per parcel ar one single-family dwelling per
fatty (4~0) acres for "TAB-40r', including labor camps,
commercial guest lodging, gxaup quarters or dwellin g
units at greater densities.
Z. Commercial wood processing plants.
3. Commercial Kennels and animal hospitals.
4. Commercial livestock feed yards.

3 might be objectionable by reason of noise, odor,
4 smoke, dust, bright light, vibration, stream pollu-
~ tion or handling of explosives or dangerous materials.
g 7'. Commercial boat ramps, docks and landing facilities.
7 8. Azrcraft Landing Facilities.
8 9. Disposal. areas. and sewage treatment facilities.
9 10. Public and quasi-public uses including schools, parks,
lp playgrounds, recreational facilities, utility system-
11 structures, meeting halls, hospitals, libraries,
12 museums, government offices and similar uses.
13 11, Private or commercial outdoor recreation facilities
l4 on sites of not less than five (5} acres, including
15 country clubs, golf courses, riding academies and
16 stables, hunting and fishing camps and other clubs,
17 and gun clubs and ranges .
18 (C) Lot Area:
lg A4inimum required area of a lot per dwelling unit .
20 shall not be less than forty (4-0) acres for "TM-40".
27. (D} Lot Width required: -
22 Minimum required lot width shall not be less than

24 (E} Front Yard xequired:
25 Minimum required front building setback shall be not
26 less than fifty (50} feet from the centerline of the

road, except where the road is classified by the County
... as a Federal Aid_Secondar.y Road, the minimum required

front building setbacle sha11 be not less than fifty-
five {55} feet .from the centerline of the road.
{F) S ide Yard required
Minimum required side building setback shall be not
less than twenty-five (25) feet far "TNI-4U".
{G) Rear Yard required:
Minimum required rear building setback sha11 be not
less than fifty [50} feet for "TM-40".
SECTION 3. All uses of land within the district not
specifically authorized and permitted are prohibited.
SECTION 4. In compliance with the provisions of said
Butte County Code, Chapter 24, the same is hereby amended by adding
this Ordinance in full.
SECTION 5. The penalties for the violation of the
zoning hereby imposed within the district shall be as provided in
the Butte County Code, Chapter 24, this Ordinance shall .from and
after its effective date become a supplement to and part of the
Butte County Code, Chapter 24.
SECTION 6. This Ordinance. shall be and it is hereby
declared to be in full force and effect from and after thirty (30}
days after the- date of its passage, and before the expiration of
fifteen (15} days after its passage , this Ordinance sha11 he
published once with the names of the members of the Board of
Supervisors voting for and against it in the Oroville Mercuxy~ ;
