HomeMy WebLinkAbout1957ORDINANCE N0. 1957 AN ORDINANCE 20NING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, A f'TM-40" [TII+'IBER I~~OUNTAIN) DISTRICT, PURSUANT TO CHAPTER 24-29. 1 The Board of Supervisors of the County of Butte, State 2 of California; under-and pursuant to Chapter 24-29-of the Butte. 3 County Cade of said County DO ORDAIN as follows: 4 SECTION 1. The hereinafter described area situated in 5 the County of Butte, State of California, shall be and it is 6 hereby zoned as a "TRH-40" (Timber A?ountain - 40 acre parcels) 7 District, and .such area sha11 be subject to the restrictions and 8 restricted uses and regulations hereinafter specified and provided.. 9 Said area so zoned being located in the unincorporated 10 area of Butte County, Oroville, more particularly described as 11 folloirs 12 All of the northwest quarter of Section 35 except 13 A portion of the East half of the northwest quarter of Section 35, more particularly described as 14 follows: 15 Commencing at the quarter corner common to Sections 2b and 35, of said township and range, south 45° 16 west, 1257 feet; thence south 46° 30' west, 3l3 ft. to the point of beginning for the parcel of land 17 herein described; thence due south, a distance of 484 feet to a point; thence due east, a distance 18 of 450 feet to a paint; thence due north, a distance of 484 feet, to a point; thence due west, a distance 19 of 4S0 feet to the point of beginning. 20 And also excepting therefrom 21 - The southwest quarter of the northwest quarter; and - the south l0 acres of the northwest quarter of the 22 northwest quarter, all in Section 35, 23 And also excepting therefrom 24 All that portion o~f the northwest quarter of the northwest quarter of Section 33, described as follows: 25 26 --- -l - 1 2 3 4 5 6 7 8 9 i 10' 11 12 13 14 15 16 17 18 1.9 20 21 22 23 24 25 26 Beginning at a point on the north line of the south 10 acres of the northwest quarter of the northwest _.:quater of. said Sec.t.ion.,35, said pont.,being in .the . ce-nt~rln.e..of..-that-:-certain ..C.ounty_..Roa.d known as the_ ....... Binet Road, from -~rhich the quarter section coiner between Section 34 and 35, said township and Range, bears south l5° 16' west, a distance of I730.90 feet; thence along the centerline of said road, the following courses and distances: North 8° 43' east, 183.60 ft.; north 70° 14' east, 63.25 ft.; south 30° 03' east, 88.40 feet; and south S3° 24' east, 297.50 ft. to a point in the north Line of said south i~0 acres of the northwest quarter of the northwest quarter of saa_d Section 35; thence along said north Line, south 88° 35' west, a distance of 413.38 feet to tl~.e point of ~ beginning. SECTION 2. REGULATIONS FOR A "TAB-40" DISTRICT: The following regulations shall apply in a "TA~i-40" District. (A) U5E S FE R~iI TTE D 1. One single family dwelling per parcel, including mobile home. 2. A4anagement, raising, harvesting and removal of trees, shrubs, seedlings, flowers, herbs and all food crops for human or animal consumption. 3. Keeping and raising sma.Il animals fax domestic use, including dogs, cats and household pets, poultry and other birds, bees, fish and frogs. 4. Prospecting, claiming, drilling, mining, excavating and dredging of mineral, hydrocarbon and geothermal resources, except as limited in Sectian (B) below. 6. Protection of land and.farests from fire, erasion, floods, .slides, quakes, insects, diseases and pollution, including arboretums and natural wilder- ness, expeximental and study areas. 7. Display and sale of products of agricultural uses and home arts and crafts produced on the premises. 8. Accessory uses, improvements and structures customary and pertinent to permitted uses, except as limited in Sectian (B) below, including guest houses, barns, sheds, shops, garages and storage areas. Residential uses other than one single-family dwell- ing per parcel ar one single-family dwelling per fatty (4~0) acres for "TAB-40r', including labor camps, commercial guest lodging, gxaup quarters or dwellin g units at greater densities. Z. Commercial wood processing plants. 3. Commercial Kennels and animal hospitals. 4. SECTION 3. All uses of land within the district not specifically authorized and permitted are prohibited. SECTION 4. In compliance with the provisions of said Butte County Code, Chapter 24, the same is hereby amended by adding this Ordinance in full. SECTION 5. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Butte County Code, Chapter 24, this Ordinance shall .from and after its effective date become a supplement to and part of the Butte County Code, Chapter 24. SECTION 6.
