AN ORDINANCE 20NING A PORTION OF THE COUr~TY OF
BUTTE, STATE OF CALIFORNIA, A "TM-10" (TIMBER MOUNTAIN -
l0 AGRE PARCELS) DISTRICT, PURSUANT TO CHAPTER 24-29.

3 Cade of said County DO ORDAIN as follows:
~ SECTION 1. The hereinafter described area situated in
~ the County of Butte, State of Calif vrnia, shall be and it is
g hereby zoned as a "TM-1Q" (Timber Mountain - 10 acre parcel) Dis-
7 trio, and such area shall be subject to the restrictions and
g restricted uses and regulations hereinafter specified and provided.
g Said area so zoned being located in the unl.ncorporated
lp area of Butte County, Chico, more particularly described as:
11 All of Lot 9 of Section 17 T23N, R3E, MDB~M. Containing
42.31 acres, more or less, north of Chico.

13 SECTION Z. REGULATIONS FOR A "TM-l0" DISTRIGT:
14 The following regulations shall apply in a "TM-10"
15 District.
16 ~ (A) USES PERMITTED.
17 1. One single-family dwelling per parcel, including
18 mobile home.
19 2. Management, raising, harvesting and removal of trees,
20 shrubs, seedlings, flowers, herbs and all food crops
21 for human or animal consumption.
22 3. Keeping and raising small animals for domestic use,
23 including dogs, cats and household pets, poultry and
24 other birds, bees, fish and frogs,
2g 4. Keeping, raising and pasturing of cattle, horses,
26 sheep, goats, hogs or other livestock, provided that

no more than two (2) such animals be kept per acre

than four (4) such animals be kept per acre on parcels
of five (5) acres or more ,
5. Prospecting, claiming, drilling, mining, excavating
and dredging of mineral, hydrocarbon and geothermal
resources, except as limited in Section {B) below.
6. Protection of land and forests from fire, erosion,
floods, slides, quakes, insects, diseases and
pollution, including arboretums and natural wilder-
ness, experimental and study areas.
7. Display and sale of products of agricultural uses
and home arts and crafts produced on the premises.
8. Accessory uses, improvements and structures customary
and pertinent to permitted uses, except as limited in
Section (B) below, including guest houses, barns,
sheds, shops, garages and storage areas.
(B) THE FOLI~OWTNG USES SUBJECT TO SECURING A USE PER~~iIT
TN EACH CASE.
1. Residential uses othex than one single-family dwelling
per parcel or one single family dwelling per ten (10)
acres for "Thy-10", including labor camps, commercial
guest lodging, group quarters or dwelling units at
greater densities.

5 smoke, dust, brigl~t light, vibration, stream pollution
s or handling of explosives or dangerous materials.
7 7. Commercial. boat ramps, docks and landing facilities.
8 S. Aircraft Landing Facilities
9 9. Disposal axeas and sewage treatment facilities.
1d 10. Public and quasi-public uses including schools, parks,
~.1 playgxounds, recreational facilities, utility
12 system structures, meeting halls, hospitals, libraries
13 museums, government offices and similar uses.
14 ll. Private or commercial autdaar recreation facilities
15 on sites of not less than five {5) acres, inc~,uding
16 country clubs, golf courses, riding academies and
17 stables, hunting and fishing camps and other clubs,
I8 and gun clubs and ranges .
19 [C} LOT AREA
20 Minimum required area of a lot per dwelling unit shalt
21 not be less than ten [10} acres for "TM-lD"..
22 [D} LOT WIDTH REQUIRED
-23 Minimum required lot width shall not be less than
24 sixty-five {fi5} feet.
25 {E} FRONT YARD REQUIRED

less than fifty (~0) feet from tl~e centerline of the
- ~ road, except whexe the road is classif-ied by the
County as a Federal Aid Secondary Road, the m~.nimum
required front building setback shall be not less i
than fifty-five (55} feet from the centerline of the
road.
(F).SIDE YARD REQUIRED.
Minimum required side building setback shall be not
less than ten (lfl) feet far "TM~-IO".
(G} REAR YARD REQUIRED
Minimum required rear building setback sha7~1 be not
less than ten (l0) feet for "TA'f-l0".
SECTION 3. All uses of land within the district not
specifically authorized and permitted axe prohibited.
SECTION 4, In compliance with the provisions of said
Butte County Code, Chapter 24, the same is hereby amended by adding
this Ordinance in full.
SECTION 5. The penalties for the violation of the zoning
hereby imposed Within the distxict shall be as provided in the
Butte County Cade, Chapter 24, this Ordinance sha11 from and aftex
its effective date became a supplement to and part of the- Butte
County Cade, Chapter 2~.
SECTION 6. This Ordinance shall be and it is hereby
declared to be in foil force and effect from and after thirty (30)
days after the date of its passage, and before the expiration of
fifteen (15} days after its passage, this Ordinance shall be publis}

ed once with the names of the members of the Board of Supervisors
(voting far -and -against it in the Chico--Enterprise Record; a news -
paper published in the County of Butte, State of California.
PASSED AND ADOPTED ~y the Board of Supervisors of the
County of Butte, State of Cal.ifaxnia, on the 1Q~th day of November,
1.978, by the fallowing vote:
