HomeMy WebLinkAbout2002ORDINANCE N0. 2002 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE , STATE OF CALTFORNIA, AN "R-3" (I~~EDIUI~~ DENSTTY RESIDENTIAL) DISTRICT, PURSUANT TO CHAPTER 24-29. 1 The Board of Supervisors of the County of Butte, State of 2 California, under and pursuant to Chapter 24-29 of the Butte County 3 Code of said County DO ORDAIN as follows: 4 SECTION I. The hereinafter described area situated in tl~e 5 County of Butte, State of California, shall be and it is hereby g zoned as an "R-3" (A~fedium Density Residential) District, and such 7 area shall be subject to the restrictions and restricted uses and g regulations hereinafter specified and provided. g Said area so zoned being located in the unincorporated 10 area of Butte County, Chico, more particularly described as follows: ZI A portipn of Lot 49 of the Foutth Subdivision of the John Bidwell Rancho, according to the 12 Official l~fap thereof on file in the office of the Recorder of the County of Butte, State 13 of California, mare particularly described as follows: Z4 Beginning at a point in the center of Twelfth 15 Avenue on the southeasterly line of said lot 49, located 245 feet northeasterly from the 16 southwest corner of said Lot 49, and running thence at right angles northwesterly 76.0 feet; 17 thence at right angles southwesterly and parallel with West Twelfth Avenue 7.0 feet; thence at 18 right angles north~,resterly 85.0 feet; thence at right angles and parallel with West 12th Avenue lg northeasterly to a point on the westerly line of West Linda Avenue; thence southeasterly along 20 western line of West Lin do Avenue 165.35 feet more or Tess to a point an the southeasterly line of 2Z said Lot 49, .also being the centerline of r'Jest 12th Avenue; thence southwesterly along centerline 22 of West 12th Avenue 125.74 feet more ar less, to point of beginning. 23 Containing 0.37 acres, more ax less, Chico. 24 2g SECTION 2. REGULATIONS FOR AN "R-3" DISTRICT: 26 - - - -l - 11 to I1 32 1.3 i4 15 1.6 17 18 I 19 20 21. 22 23 24 2g 2s The following regulations sha11 apply in an "R-3" District . . (A) USES PER~4ITTED 1. One-family dwellings, two-family dwellings and multi- ple family dwellings, not including tents, trailers, or mobile homes. 2. Accessory buildings pertinent to the permitted uses. 3. Household pets {but not including livestock, poultry or poisonous reptiles} . {B) THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT I EACH CASE: 1. Golf Courses and country clubs. 2. Public and quasi-public uses including churches, fire houses, hospitals, parks and playgrounds, schools and public utility buildings. ~. Sales tract office. . {C) The provisions of Section 24-33 shall apply. SECTION ~. All uses of land within the district not specifically authorized and permitted are prohibited. SECTION 4. 7n compliance with the provisions of said Butte County code, Chapter 24, tl~.e same .is hereby amended by adding this Ordinance in full. SECTION 5. SECTION b.....TI~is Ordinance s~a11 be and it is hereby declared to be in fu11 force and effect from and after thirty {30) days after the date a.f its passage, and before the expiration of fifteen {15) days after its passage, this Ordinance sha11 be published once with the names of the members of the Board of Super- visors voting far and against it in the Chico Enterprise Record, a newspaper published in the County of Butte, State of California.
