The Board of Supervisors of the County of Butte, State of
California, D.O..-.ORDAIN as.foll.ows:. _...
Section 1. That Section 13-120 is hereby added to the
Butte County Code to read as follows:
§13-120. The Board of Supervisors has found and deter-
mined that historical1y,extensive areas of good agricultural land
were rendered useless for agricultural purposes by dredging
operations for gold and other minerals. Many of these areas could
be reclaimed and replaced in agriculture production providing that
an economic and practical means of removing rock and gravel can be
attained.
Section 2. That Section 13-122°is hereby-added to the
Butte County .Code to read as follows:
§13-122. Notwithstanding anything to the contrary in
this code, where temporary rock crushing operations are to be
conducted for~the purpose of restoring agriculture land to use
for agricultural production, a temporary permit, not to exceed
ninety (90} days in term, may be granted by the director of public
works. This temporary permit shall include the plan referred to
in this chapter which shall demonstrate that upon removal of the
rock or aggregate in question, th_e land v~rill be reclaimed and
placed into agricultural production. Provided further, that no
extensions shall be granted for such temporary permits and that
the crushed rock and gravel shall-not be sold commerically.
Section 3. This urgency ordinance shall take effect
immediately upon its passage, and before the expiration of fifteen

{15) days after its passage shall be published once with the names
of-the members of the Board of. Supervisors voting for .anal against
the same i n the ~roville Mercury _ a newspaper
in general circulation in the County of Butte, State of California.
The facts constituting the urgency on which this ordinance is
.based are:
7. It is necessary to immediately put this temporary
permit process into effect so as to permit reclamation of
agriculture lands in time for planting this year.
2. The removal of dredgings will facilitate mosquito
and other pest control, prior to spring when the mosquitos and
other pests break diapause.
PASSED AND ADOPTED by the Butte County Board of
Supervisors thi s 13th day of February __ __~ 1979 ~ by
the following vote:
AYES: Supervisors Dolan, Moseley, W}-~eeler and-Chairman Lemke
NOES: None
ABSENT: Supervisor Winston
